' RESOLUTION N0.59 <br />SERIES 2007 <br />A RESOLUTION APPROVING ~- PURCHASE CONTRACT TO BUY AND SELL REAL <br />ESTATE FOR SALE OF THE DAMYANOVICH HOMESTEAD PARCEL <br />WHEREAS, the City of Louisville is the owner of a certain 1.2186-acre parcel of real <br />property located in unincorporated Boulder County and legally described in Exhibit A attached <br />hereto, which property has a street address of 7507 Dyer Road, Louisville, Colorado, is commonly <br />referred to as the Damyanovich Homestead Parcel, and is hereinafter referred to as the "Property"; <br />and <br />WHEREAS, the Property, which contains an existing house, barn, and accessory buildings, <br />was not acquired and is not being held or used for any park, open space, municipal or governmental <br />purposes, and the Property was acquired solely as excess property and a general asset to be sold and <br />disposed of in order to help defray the costs of the City's acquisition of open space located adjacent <br />to the Property; and <br />WHEREAS, the City Council desires to sell the Property, and has received a proposed <br />Purchase Contract to Buy and Sell Re-a1 Estate for sale of the Property for $490,000; and <br />WHEREAS, the City desires to sell the Property upon the terms and conditions of a <br />mutually agreeable purchase contract,. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The proposed Contract to Buy and Sell Real Estate between the City of Louisville <br />and John and Julie McKenna, for sale of the Property described in Exhibit A attached hereto, is <br />hereby approved in essentially the same form as the copy of such Contract accompanying this <br />Resolution. <br />2. The Mayor is authorized to execute the Contract, except that the Mayor is hereby <br />granted the authority to negotiate and approve such revisions to said Contract as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Contract are not: altered. <br />3. The Mayor, City Manager and City Staff are further authorized to do all things <br />necessary on behalf of the City to pf;rform the obligations of the City under the Contract, and are <br />further authorized to execute and deliver any and all closing documents and other documents <br />necessary to effect the sale of the Property under the terms and conditions of said Purchase <br />Contract. <br />PASSED AND ADOPTED 1:his 1L~ day of , 2007. <br />1 <br />
