RESOLUTION N0.60 <br />SERIES 2007 <br />A RESOLUTION APPROVING A GRANT OF TEMPORARY CONSTRUCTION <br />EASEMENT TO THE COUNTY OF BOULDER FOR STATE HIGHWAY 170 <br />(MARSHALL ROAD) SHOULDER IMPROVEMENTS <br />WHEREAS, the County of Boulder, in coordination with the Colorado Department of <br />Transportation (CDOT), is undertaking the construction of paved shoulders and other <br />improvements on State Highway 170 (Marshall Road), a portion of which abuts the City of <br />Louisville's Howard T. Berry Water Treatment Plant property; and <br />WHEREAS, Boulder County has requested the City grant a temporary construction <br />easement for the project and a Memorandum of Agreement has been proposed for such purpose; <br />and <br />WHEREAS, the City by this Resolution desires to approve the Memorandum of <br />Agreement and authorize its execution. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />1. The proposed Memorandum of Agreement ("Agreement") between the City of <br />Louisville, as grantor, and the County of Boulder, as grantee, for the conveyance of a temporary <br />construction easement, is hereby approved in essentially the same form as the copy of such <br />Agreement accompanying this Resolution. <br />2. The Mayor is authorized to execute the Agreement, except that the Mayor is hereby <br />granted the authority to negotiate and approve such revisions to said Agreement as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of the Agreement Easement are not altered. <br />PASSED AND ADOPTED 1:his ~ day of /~ 2007. <br />Varra, ~ity Clerk <br />1 <br />
