<br />Section 3. The restrictions contained in this ordinance shall not apply to any application
<br />for any residential development which is to be owned and operated by a housing authority,
<br />
<br />Section 4. The restrictions contained in this ordinance also shall not be construed to
<br />affect any residential development or use under a final Planned Unit Development (PUD)
<br />development plan, special review use, or PCZD general development plan which has been finally
<br />approved by resolution of the Louisville City Council and which is in conformance with all
<br />ordinances, resolutions, rules, regulations, policies and conditions applicable to such approval, or to
<br />affect any final PUD development plan for which a complete application has been filed with the
<br />Planning Department prior to the effective date hereof.
<br />
<br />Section 5. The provisions of this ordinance are temporary in nature and may be
<br />repealed by a subsequent legislative enactment. The temporary moratorium established by this
<br />ordinance shall terminate as of September 7, 2005 unless sooner repealed.
<br />
<br />Section 6. The City Council herewith finds, determines and declares that this
<br />ordinance is necessary for the immediate preservation of the public health, safety and welfare in
<br />order to timely effectuate the moratorium set forth herein. The City Council herewith further
<br />finds, determines and declares that it is necessary for this ordinance to take effect immediately
<br />upon adoption in order to allow for completion of the Citywide Comprehensive Plan review
<br />process prior to processing requests for development subject to the moratorium herein
<br />established, and to mitigate the adverse impacts of processing such development while the
<br />Citywide Comprehensive Plan review is ongoing, As an emergency ordinance, this ordinance
<br />shall take effect August 2, 2005, provided the same has been adopted and signed by the Mayor
<br />and approved by two-thirds of the entire City Council.
<br />
<br />Section 7. If any portion of this ordinance is held to be invalid for any reason, such
<br />decision shall not affect the validity of the remaining portions of this ordinance, The City Council
<br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact
<br />that anyone part be declared invalid.
<br />
<br />Section 8. The repeal or modification of any provision of the Municipal Code of the
<br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole
<br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred
<br />under such provision, and each provision shall be treated and held as still remaining in force for the
<br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the
<br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any
<br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits,
<br />proceedings, or prosecutions,
<br />
<br />Section 9. All other ordinances or portions thereof inconsistent or conflicting with this
<br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
<br />
