Louisville City Council Meeting <br />December 17, 2002 <br />Page 8 <br /> <br />CITY MANAGER'S REPORT <br /> <br />City Manager Bill Simmons reported there would be a closing with the Town of Superior <br />on the purchase of water rights on Friday, December 20, 2002. He reported the closing <br />on the 1.6-acre Smethills property on Spruce Street was Friday, December 13, 2002. <br />That property has been added to the open space inventory. He reviewed a letter sent to <br />AT & T Broadband, relative to their proposed closure of the local office. The letter <br />voices the City's objection to the proposed closure and outlines their Franchise <br />Agreement with the City, which specifies a local office. <br /> <br />Simmons asked Deputy City Manager Julie Boyd to update Council on the success of <br />Workman's Compensation plan. <br /> <br />Deputy City Manager Boyd reported that 2002 was a very good year for the City. She <br />explained losses were down, and the City received a dividend check for $32,521. She <br />noted the Human Resources Department has worked diligently to put the City on the top <br />tier of rates, to receive the lowest rates possible. She recognized Human Resource <br />Manager Jane Turk for her work. <br /> <br />Simmons recognized the work of the Employees Safety Committee. He explained the <br />committee is made up of one employee from every department that works on safety <br />issues throughout the City. <br /> <br />COUNCIL COMMENTS AND COMMITTEE REPORTS <br /> <br />Sisk explained some citizens have voiced concern relative to the single bid process of the <br />inline rink. He asked City Attorney Light to review the matter to ensure the City <br />ordinance has been followed. <br /> <br />City Attorney Light stated the purchasing policies of the City do allow for sole source <br />procurement under certain criteria. The decision has been delegated to the City Manager. <br />With respect to the inline skating project, the Land Management Department has sent <br />notice to the City Manager as required, stating the justification for the sole source <br />purchase. The next step is for the City Manager to complete a review and make a <br />determination as to whether sole source purchase has been clearly justified under those <br />procedures. He explained the contract authorized is a design/bid contract, and certain <br />components of the contract will be through a public bid process. He noted as a <br />transitional item to the Home Rule Charter, Council should look at all the bidding <br />requirements. <br /> <br />Sisk asked Light if the memorandum should have been submitted prior to Council action <br />on the contract. Light explained under the purchasing policies, there is not a particular <br />role for Council in making the determination that the sole source purchase is justified. <br />He noted Council must approve the appropriation and the contract. <br /> <br /> <br />
