<br />including analysis of appropriate locations for additional residential development, the impacts of <br />residential development, and the policies under which such development might occur; and <br /> <br />WHEREAS, in light of the pending review of the Citywide Comprehensive Plan, the <br />City Council previously imposed a temporary moratorium on the processing of applications for <br />rezonings, special review uses and Planned Community Zone District (PCZD) general <br />development plan amendments for new residential development by Ordinance No. 1450, Series <br />2004, which moratorium expired on March 31, 2005; and <br /> <br />WHEREAS, in light of the continued review of the Citywide Comprehensive Plan, City <br />Council finds it appropriate to impose a temporary moratorium on the processing of applications <br />for rezonings, special review uses, and PCZD general development plan amendments for new <br />residential development; and <br /> <br />WHEREAS, the City Council finds that such a moratorium will permit the City an <br />appropriate amount of time to continue and complete its Citywide Comprehensive Plan review; <br />will foster sound land use planning and governmental decision making; and will not affect the <br />development of properties which are currently permitted by right to pursue residential <br />development upon compliance with all other City ordinances, rules, regulations, policies and <br />design guidelines; and <br /> <br />WHEREAS, the City Council has held a public hearing on the temporary moratorium. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this <br />reference as findings of the City Council. <br /> <br />Section 2. Upon the effective date of this ordinance, and until August 2, 2005, no <br />application for approval of a rezoning, a special review use, or a Planned Community Zone District <br />(PCZD) general development plan amendment for new residential development or use shall be <br />reviewed, processed, approved, issued, or otherwise acted upon for any property within the City of <br />Louisville. <br /> <br />Section 3. The restrictions contained in this ordinance shall not apply to any application <br />for any residential development which is to be owned and operated by a housing authority. <br /> <br />Section 4. The restrictions contained in this ordinance also shall not be construed to <br />affect any residential development or use under a final Planned Unit Development (PUD) <br />development plan, special review use, or PCZD general development plan which has been finally <br />approved by resolution of the Louisville City Council and which is in conformance with all <br />ordinances, resolutions, rules, regulations, policies and conditions applicable to such approval, or to <br />affect any final PUD development plan for which a complete application has been filed with the <br />Planning Department prior to the effective date hereof. <br /> <br />2 <br />
