discharge standard means any regulation developed under the authority of 307(b) <br /> of the Act and 40 CFR, Section 403.5. <br /> Pollutant means any dredged spoil, solid waste, incinerator residue, <br /> sewage, garbage, sewage sludge, explosives, chemical wastes, corrosive <br /> substances, biological materials or nutrients, radioactive materials, heat, <br /> malodorous substances, wrecked or discharged equipment, rock, sand, slurry, <br /> cellar dirt, untreatable waste or industrial, municipal, and agricultural, or medical <br /> waste discharged into water or with water. <br /> Publicly owned treatment works (POTW) means a treatment works as <br /> defined by Section 212 of the Act, (33 USC § 1292) which is owned in this <br /> instance by the city. The term also means the municipality, as defined in section <br /> 502(4) of the Act, which has jurisdiction over the indirect discharges to and the <br /> discharges from such a treatment works. This definition includes any sewers that <br /> convey wastewater to the POTW treatment plant, but does not include pipes, <br /> sewers or other conveyance not connected to a facility providing treatment. For <br /> the purposes of this chapter, "POTW" shall also include any sewers that convey <br /> wastewaters to the POTW from persons outside the city who are, by contract or <br /> agreement with the city, users of the city's POTW. <br /> Section 2. Section 13.32.050 of the Louisville Municipal Code is amended by the <br /> insertion of a new subsection A to read as follows with the remainder of the section to be re-lettered <br /> accordingly: <br /> Sec. 13.32.050. Further standards and limitations. <br /> A. Best Management Practices (BMPs). Pursuant to 40 CFR <br /> 403.5(c)(4), POTW's may develop Best Management Practices (BMPs) to <br /> implement the prohibitions listed in paragraphs (c)(1) and (c)(2) of said sections of <br /> 40 CFR 403.5. Such BMPs shall be considered local limits and pretreatment <br /> standards for the purposes of this chapter and section 307(d)of the Act. <br /> Section 3. Section 13.32.060 of the Louisville Municipal Code is hereby amended to <br /> read as follows(words to be deleted are stricken-through;words to be added are underlined): <br /> Sec. 13.32.060. Wastewater discharge permit requirement. <br /> A. Legal authority. POTW shall operate pursuant to legal authority <br /> enforceable in federal, state, or local courts, which authorizes or enables the POTW <br /> to apply and to enforce the requirements of sections 307(b) and (c)and 402(b)(8) of <br /> the Act and any regulations implementing those sections. Such authority may be <br /> contained in statute, ordinance, or a series of contracts or joint power agreements <br /> which the POTW is authorized to enact, enter into or implement, and which are <br /> authorized by state law.
