completion of the City Staff's study of the issues and possible adoption of regulations or a <br /> prohibition on such businesses may undermine and defeat the City's ability to promote and protect <br /> the public health, safety,and welfare;and <br /> WHEREAS,the City Council finds and determines that it is necessary and appropriate to <br /> institute a temporary moratorium until December 31,2014 on accepting, reviewing,approving,or <br /> otherwise acting upon applications or requests for business registration, sales tax licenses, <br /> building permits, and certificates of occupancy for any business that permits or invites private <br /> assembly for the purpose of the use or consumption of marijuana or marijuana products and on the <br /> establishment or operation of any such business within the City; <br /> NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE,COLORADO: <br /> Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this <br /> reference as findings of the City Council. <br /> Section 2. Upon the effective date of this ordinance,and until December 31,2014,no <br /> application or request for business registration, sales tax license,building permit,or certificate of <br /> occupancy for any business that permits or invites private assembly for the purpose of the use or <br /> consumption of marijuana or marijuana products shall be received, reviewed,approved,or <br /> otherwise acted upon nor shall any person or business during such period establish or operate a <br /> business that permits or invites private assembly for the purpose of the use or consumption of <br /> marijuana or marijuana products. <br /> Section 3. During the period this ordinance remains in effect,City Staff shall monitor <br /> the State's regulatory efforts and judicial interpretations of Amendment 64,research the applicable <br /> legal and land use issues connected to the regulation of businesses permitting or inviting private <br /> assembly for the purpose of the use or consumption of marijuana or marijuana products,and study, <br /> develop,review and evaluate appropriate regulations or recommendations pertaining to such <br /> businesses for presentation to and consideration by the City Council. <br /> Section 4. The provisions of this ordinance are temporary in nature and may be <br /> repealed by a subsequent legislative enactment. The temporary moratorium established by this <br /> ordinance shall terminate as of December 31,2014 unless sooner repealed. <br /> Section 5. The City Council herewith finds, determines and declares that this <br /> ordinance is genuinely and urgently necessary for the immediate preservation of the public <br /> health, safety and welfare because existing regulations are inadequate to address the potential <br /> impacts of businesses permitting or inviting private assembly for the purpose of the use or <br /> consumption of marijuana or marijuana products on the health, safety, and welfare of the <br /> community.The City Council also herewith finds that the possibility of establishment of such <br /> businesses prior to the adoption of state or local regulations determining how such businesses <br /> may be regulated could not have been reasonably anticipated or foreseen and is a matter on which <br /> immediate action is genuinely and urgently necessary for the preservation of public, health, <br /> safety, and welfare. Therefore, City Council herewith further finds, determines and declares that <br /> Ordinance No.1630,Series 2013 <br /> Page 3 of 4 <br />
