<br />RESOLUTION NO. 39 <br />SERIES 1993 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT FOR <br />COLONY SQUARE (18.2 ACRES) AND A FINAL PUD <br />DEVEWPMENT PLAN FOR MANN THEATERS <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by 1007 <br />Corporation, represented by Bob Brisnehan, a request for approval of a Final Subdivision Plat <br />for Colony Square (18.2 Acres) and a Pinal PUD Development Plan for Mann Theaters. <br /> <br />WHEREAS, all materials related to the Pinal Subdivision Plan and Pinal PUD <br />Development Plan have been reviewed by city staff and the Planning Commission and found to <br />be in compliance with the Louisville zoning ordinances, subdivision regulations, and related <br />policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Pinal Subdivision <br />Plat and Pinal PUD Development Plan, the Planning Commission recommended to the City <br />Council approval with the following conditions: <br /> <br />1. Pedestrian/bicycle connections between McCaslin Boulevard, across existing <br />City-owned open space to the theater must be coordinated with City and <br />included in this first phase of construction. <br /> <br />2. The landscape plan needs to include quantities of proposed landscape materials. <br /> <br />3. A copy of lighting plan showing intensity of proposed parking lot lighting must <br />be submitted prior to recording of final PUD development plan. <br /> <br />4. Show additional ROW to be acquired from Homarl for intersection <br />improvements. Note that all improvements to Dyer Road must be completed as <br />pari of this project. <br /> <br />5. Show easement on Tract A for proposed sign. <br /> <br />6. No drainage flow greater than the historical rate shall be pennitted into the <br />existing wetlands area. <br /> <br />7. The developer shall submit, for City review and approval, Design Guidelines <br />which should be incorporated into the Final PUD prior to Council review. <br />
