Louisville City Council Meeting <br />November 4, 2003 <br />Page 6 of 10 <br /> <br />Bruce Hamon, 5670 Franklin Street, Denver, CO, CEO of Hamon Contractors, addressed <br />the bid process and commended Public Works Director Tom Phare and his staff. He <br />stressed Hamon Contractors were in low bidder. He addressed the bid documents and <br />cited various sections, which pertained to the bid process as outlined by the City. He <br />reviewed Staff's recommendation in the Council Communication and stated there are <br />substantial reasons for rejecting the Lawrence Bid and noted further acceptance of the bid <br />may impact the City at another time. He summarized the reasons for Council to reject the <br />Lawrence bid and award Hamon Contractors the contract. <br /> <br />COUNCIL COMMENTS <br /> <br />Mayor Davidson asked City Attorney Light to review the City's options. City Attorney <br />Light reviewed the options available as follows: 1) Award contract to Lawrence <br />Construction Company, 2) Reject the Lawrence bid and award to the next low bidder, or <br />3) Reject all bids. <br /> <br />Mayor Pro Tem Sisk asked a representative from Lawrence Construction Company to <br />respond. Rick Lawrence, Lawrence Construction Company, Littleton, CO, explained the <br />errors were made by an estimator, working in the field, who got off line on the bid <br />documents, and the unit prices and the extensions were wrong on approximately seven <br />units. He noted the total bid amount would not be changed. <br /> <br />Mayor Pro Tem Sisk asked Hamon if he had solicited the letter from Colorado <br />Contractors. Hamon responded yes. <br /> <br />Mayor Pro Tem Sisk asked Hamon to explain their process. Hamon stated all the work is <br />done at the home office, and sent to the estimator working in the field. <br /> <br />Mayor Pro Tern Sisk asked if Lawrence had read the letter. Lawrence stated he read and <br />agreed with the letter, however, there are instances where bids are corrected, and the bid <br />documents provide for correction as long as the total bid amount does not change. <br /> <br />Council member Van Pelt asked Phare what the total bid would have been on the units <br />and extensions as presented by Lawrence Construction Company. Phare stated 15 <br />Million, and after correction of the errors, the bid would be 6.0 Million. <br /> <br />Council member Brown asked if Lawrence Construction Company was aware of the <br />errors when their bid was opened. Phare stated yes. <br /> <br />Council discussion: Council member Marsella stated the integrity of the bid process must <br />be preserved, and she could not support the Lawrence bid. Mayor Davidson stated it was <br />unfair to allow the bid to be corrected after the bid opening and suggested Council reject <br />all bids. Council member Van Pelt stated it would be unfair to the other bidders to reject <br />all bids and voiced her support of the Hamon Construction bid.
