Louisville City Council Meeting
February 5, 2002
Page 6
of light poles at the ball field, and suggested that they could be utilized to conceal
telecommunication facilities.

City Manager Bill Simmons clarified that a freestanding tower facility is still prohibited
in the City of Louisville.

Hearing no other public comment, Davidson closed the public hearing

MOTION: Sisk moved that Council approve Ordinance No. 1374, Series 2001, as
amended, seconded by Brown. Roll call vote was taken. The motion passed by a vote of
7-0.

ATTORNEY'S REPORT

City Attorney Sam Light reported that the defense attorney in the Qwest litigation has
forwarded the order for dismissal of the lawsuit. Light noted that the dismissal was not
related to the last agenda item. He voiced his understanding from defense counsel that
Qwest secured an alternative site, which would provide acceptable coverage and
therefore decided to withdraw the lawsuit with prejudice. As part of the dismissal, each
party would pay its own attorneys fees and costs.

CITY MANAGER'S REPORT

City Manager Bill Simmons noted that in the Business Section of the Daily Camera
Newspaper, a Boulder firm is leasing 39,000 SF at CTC. He stated that it is a major lease
deal and a significant transaction. Additional, Simmons stated that he has received word
that Coherent Technologies will be breaking ground for a new 65,000 SF building at the
CTC location.

Simmons reported that Staff met to hear proposals for the needs assessment for the
Recreation/Senior Center. He stated that Staff interviewed three architect firms for the
Library needs assessment. He thanked Mayor Davidson, and Council members Brown
and Van Pelt for their attendance at those meetings. He estimated that some preliminary
needs assessments, with respect to total square footage, should be available in May.
Those figures and the associated cost will be available for 2003 budget process.

Simmons reported on the two agenda items for the February 12, 2002 work session. The
first item will be discussion of the downtown-parking fee. Council will meet with the
Downtown Business Association. The second item will be Staff presentation of the first
draft of the Sales Tax ordinance.

COUNCIL COMMENTS AND COMMITTEE REPORTS
