certifications, forms, memoranda of understanding, option letters, contract amendments and <br />other documents required in connection with the Contract and project. <br />4. The City's obligation to make payments under the Contract is from year to year <br />only, and payments of the City contribution for fiscal years 2014 and 2015 is subject to annual <br />budgeting and appropriation in the sole and absolute discretion of the City Council. Nothing in <br />the Contract shall be deemed or construed as creating a multiple fiscal year obligation on the part <br />of the City within the meaning of Colorado Constitution, Article X, Section 20, and the City's <br />obligations under the Contract are expressly conditioned upon annual appropriation by the City <br />Council. <br />PASSED AND ADOPTED this day of <br />2 <br />, 2013. <br />Robert P.
