RESOLUTION NO. 26 <br />SERIES 2013 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH <br />THE CITY OF LAFAYETTE FOR A LIFT STATION EMERGENCY OVERFLOW <br />CONNECTION <br />WHEREAS, the development of the North End Phase II Subdivision within Louisville <br />includes a sanitary sewer lift station, which includes an emergency overflow connection to the City <br />of Lafayette sanitary sewer collection system; and <br />WHEREAS, the City of Lafayette has existing waste water facilities which have the <br />capacity to convey and treat sanitary sewer overflow discharges from the North End Phase II <br />sanitary sewer lift station; and <br />WHEREAS, there has been proposed between Louisville and Lafayette an <br />intergovernmental agreement to establish responsibilities for the sanitary sewer lift station <br />emergency overflow connection to Lafayette's sanitary sewer collection system; and <br />WHEREAS, the Parties are authorized to enter into this Agreement pursuant to their <br />respective charters and state law, including but not limited to C.R.S. § 29 -1 -203, and the City <br />Council by this Resolution desires to approve said agreement and authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The Proposed Intergovernmental Agreement between the City of Louisville and the <br />City of Lafayette for a lift station emergency overflow connection for the North End Phase II <br />sanitary sewer lift station (the "1GA "), is hereby approved in essentially the same form as the copy <br />of such IGA accompanying this Resolution. <br />2. The Mayor is authorized to execute the IGA on behalf of the City, except that the <br />Mayor is hereby further granted authority to negotiate and approve such revisions to said IGA as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the IGA are not altered. <br />3. The Mayor, City Manager, Director of Public Works and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the IGA. <br />PASSED AND ADOPTED this `'N11 day of , 2013. <br />Robert P.
