<br />RESOLUTION NO.3 <br />SERIES 1993 <br /> <br />A RESOLUTION APPROVING A FINAL PUD DEVELOPMENT PLAN AND <br />FINAL SUBDIVISION PLAT FOR WEST PINE STREET VILLAGE <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Spruce Street <br />Joseph, Ltd., represented by Jonathan Prouty, a request for approval of a Final PUD <br />Development Plan and Final Subdivision Plat for West Pine Street Village. <br /> <br />WHEREAS, all materials related to the Final PUD Development Plan and Final <br />Subdivision Plat have been reviewed by city staff and the Planning Commission and found to <br />be in compliance with the Louisville zoning ordinances, subdivision regulations, and related <br />policies; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final PUD <br />Development Plan and Final Subdivision Plat, the Planning Commission recommended to the <br />City Council approval with conditions: <br /> <br />1. At the request of the applicant, Commission supporls a cash in lieu of payment <br />rather than land dedication. Staff does not suppOrl the acceptance of Outlots 1 and 2. <br /> <br />2. Pennanent subdivision identificationlsignage will not be allowed. <br /> <br />3. A special provision of the subdivision agreement shall require HOA to maintain <br />both private access drive and the public alley. <br /> <br />4. A special provision to the subdivision agreement shall restrict fencing of Outlot 1. <br />Any proposal to fence shall require an amendment to the PUD. <br /> <br />5. Garage eves shall not encroach into any adjacent lot unless provided for by a <br />separate maintenance easement. <br /> <br />6. Rear yard fencing beyond the south building line of all garages shall be restricted <br />to a 4' high, california chain link fence. <br /> <br />7. All interior fences shall be maintained by the HOA. <br /> <br />8. Strike alley closure language. <br />
