Louisville City Council Meeting <br />March 19, 2002 <br />Page 5 <br /> <br />Mayer excused Mayor Pro-Tem Sisk from the Avista Hospital Annexation proceedings. <br /> <br />Mayer called for City Attorney introduction of ordinances. <br /> <br />City Attomey Light read Ordinances Nos. 1379 and 1380, Series 2002. <br /> <br />Mayer called for Staff presentation. <br /> <br />Planning Director Paul Wood reviewed the Avista Adventist Hosptial Annexation <br />Agreement, Ordinance No. 1379, Series 2002, which annexes the subject property and <br />Ordinance No. 1380, Series 2002, which zones the property. Wood reviewed that Council <br />approved the US 36 Intergovernmental Agreement, which establishes 9.09- acres as <br />Rural Preservation. <br /> <br />Wood reported that the execution of the Avista Adventist Hospital Annexation <br />Agreement is required prior to final action by Council on Ordinance No. 1379, Series <br />2002. He noted that the annexation agreement is acceptable to the owner, Staff and City <br />Attorney. He reviewed that Section 5 of the agreement has the effect of requiring the <br />owner to dedicate required easements and right-of-way adjacent to the property as well as <br />to install certain public improvements. The agreement also requires that the property <br />complete the inclusion process into the Northern Colorado Water Conservancy District. <br />He noted a special provision added to Section 14 of the Agreement, which commits the <br />Owner to convey the 1 O-acre donation parcel by fee dedication to the City of Louisville. <br /> <br />Wood reviewed Ordinance No. 1380, Series 2002, and the zoning designation of Planned <br />Community Zoned District - Commercial (PCZD-C). The zoning requests is in the form <br />of a General Development Plan (GDP), which would be processed as an amendment to <br />the existing GDP approved in 1998. The 1998 GDP changed the zoning of the property <br />from Agriculture to Planned Community Zoned District and included a 100' setback plus <br />a 50' setback along the north property for one-story development. A three-story <br />development was limited to a 200' setback. The changes in the amended GDP reflect that <br />all the development, one-two-or three-stories are restricted to a 200' setback, with a <br />three-story setback of 210'. The setback requirement between building structures and US <br />36 has been retained at 200'. Parking lot and driveway improvements are retained at a <br />100' setback from US 36. <br /> <br />Mayer called for applicant presentation. There was no applicant presentation. <br /> <br />Mayer opened the public hearing and asked for public comment on the Avista Hospital <br />Annexation, Annexation Agreement and Zoning. There were no public comments. <br /> <br />COUNCIL COMMENTS <br /> <br />Mayer asked if Council was being asked to approve a General Development Plan, in <br />addition to the Annexation and Zoning. <br /> <br /> <br />
