Louisville City Council Meeting
March 19, 2002
Page 7

Keany noted that the original plan called for one and two buildings. Wood stated that the
northeast comer of the development is restricted to low density, which would include one
and two story buildings. The western portion of the development is medium density and
may have up to three story buildings. The high-density zoning permits four story
buildings.

Simmons asked for the setbacks from the north property line. Wood stated that the
setback for a one-story building is 100' and 200' for three-story building from the
common property line.

Sackett noted that the buildings will be higher closer to the hospital. He acknowledged
and thanked the City Staff and City Attorney for the many hours that were dedicated to
the hospital project.

Mayer asked for any additional comments from the public. There were no public
comments.

Simmons asked Planning Director Wood, which Section of the GDP would be affected
by the revised setbacks. Wood stated that Section 13A of the Amended General
Development Plan would have to be changed to reflect the new property line.

City Attorney Light stated that language could be included to indicate that the General
Development Plan shall be amended to reflect an additional 50' setback along the north
boundary line for three-story buildings. He noted that currently the Amended GDP will
reflect the new property line after the land trade.

City Attorney Light reviewed that the three items before Council are the Revised
Annexation Agreement, the Annexation Ordinance and the Zoning Ordinance. He noted
that only Porter Care (Avista Hospital) will sign the Annexation Agreement, therefore,
changes had to be made to the Ordinance, to allow for the property to be under one
ownership.

AVISTA HOSPITAL ANNEXATION AGREEMENT

MOTION: Keany moved that Council approve the Avista Adventist Hospital
Aannexation Agreement, as amended, seconded Levihn. Roll call vote was taken. The
motion passed by a vote of 5-0. Sisk and Davidson excused.

ORDINANCE NO. 1379, SERIES 2002 - AN ORDINANCE APPROVAL AN
ANNEXATION KNOWN AS THE AVISTA ADVENTIST HOSPITAL
ANNEXATION, TO THE CITY OF LOUISVILLE

7
