RESOLUTION NO. 36 <br />SERIES 2013 <br />A RESOLUTION APPROVING PRELIMINARY SUBDIVISION PLAT AND <br />PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) FOR AN APPROXIMATE 11 <br />ACRE PARCEL OF THE CALEDONIA PLACE AND COAL CREEK STATION <br />SUBDIVISIONS INCLUDING 51 RESIDENTIAL UNITS AND 34,335 SQUARE FEET <br />OF COMMERCIAL SPACE. <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a preliminary subdivision plat and preliminary planned unit <br />development (PUD) plan for the proposed Coal Creek Station development located in <br />northeast Louisville; and, <br />WHEREAS, all materials related to the preliminary subdivision plat and <br />preliminary planned unit development (PUD) plan have been reviewed by City Staff and <br />the Planning Commission and found, subject to conditions, to be in compliance with the <br />Louisville zoning ordinances, subdivision regulations, and related policies; and <br />WHEREAS, the City Staff has reviewed the information submitted and found <br />that, subject to conditions, the application complies with the Louisville zoning and <br />subdivision regulations and other applicable sections of the Louisville Municipal Code; <br />and, <br />WHEREAS, after duly noticed public hearing where evidence and testimony was <br />entered into the record, including without limitation the findings in the Louisville <br />Planning Commission Staff Reports dated June 13, 2013, the City of Louisville Planning <br />Commission approved a resolution to forward a recommendation of approval, with <br />conditions to the City Council; and, <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that said preliminary <br />subdivision plat and preliminary planned unit development (PUD) plan should be <br />approved, subject to the following conditions: <br />1. The applicant shall widen the sidewalk path along South Boulder Road to eight <br />feet for the entire length of the development. <br />2. The maintenance of the southernmost alley will be determined before final <br />approval of the plat and PUD. <br />3. The applicant shall secure access on the west end of the southernmost alley <br />before final approval of the plat and PUD. <br />4. The applicant will provide radii and turning templates at all street corners to show <br />accessibility by fire trucks and other large vehicles. <br />5. The applicant shall rezone the property in compliance with Exhibit A of LMC <br />Chapter 17.14 at or before the approval of final PUD. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado, based on the evidence and testimony presented at the hearings, <br />Resolution No., Series 2013 <br />Page 1 of 2 <br />
