RESOLUTION NO. 37 <br />SERIES 2013 <br />A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT, FINAL <br />PLAT, AND SPECIAL REVIEW USE TO PERMIT THE CONSTRUCTION OF FIVE (5) <br />BUILDINGS, THREE (3) OF WHICH WILL CONTAIN A TOTAL OF 111 APARTMENT <br />UNITS OVER STRUCTURED PARKING, AND TWO (2) OF WHICH WILL CONTAIN <br />36,000 SQUARE FEET OF RETAIL DEVELOPMENT, ON TRACT I OF THE <br />LOUISVILLE NORTH 7TH FILING SUBDIVISION LOCATED AT 707 E SOUTH <br />BOULDER ROAD. <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a final planned unit development, final plat, and special <br />review use to permit the construction of five (5) buildings, three (3) of which will contain <br />a total of 111 apartment units over structured parking, and two (2) of which will contain <br />36,000 square feet of retail development, on Tract I of the Louisville North 7th Filing <br />subdivision located at 707 E South Boulder Road; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with Louisville Municipal Code (LMC) Chapters 17.28 and 16.12, and the special <br />review use criteria as set forth in LMC Section 17.40.100, and other applicable <br />requirements; and <br />WHEREAS, after a duly noticed public hearing on June 13, 2013, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated June 13, 2013, the Planning <br />Commission recommended the final planned unit development, final plat, and special <br />review use permit be approved with the following conditions: <br />1. Prior to City Council, the change panel sign shown on the western facade of <br />the building be removed from the sign plan and the following text will be <br />added: "Total square footage of wall and banner signs allowed is 505 SF ". <br />2. Prior to City Council review, the Parking note on the cover will be amended to <br />read as follows: <br />"The base ratio of residential parking spaces is 1.65 <br />spaces /unit available in the parking structure and surface <br />spaces. In the retail parking lot, 41 spaces shall be labeled <br />with signage permitting overnight residential parking from <br />8:00 PM to 8:00 AM (Off -hours for retail building). This <br />overnight residential parking ratio of 2.0 spaces /unit is a <br />requirement of this PUD and may not be eliminated, <br />reduced, or otherwise changed without first obtaining City <br />approval of a PUD amendment." <br />Resolution No. 37, Series 2013 <br />Page 1 of 2 <br />
