City Council <br />Meeting Minutes <br />July 2, 2013 <br />Page 7 of 22 <br />City Attorney Light read Ordinance Nos. 1633 and 1634, Series 2013. He noted the <br />property rezoning must be noticed (posted) fifteen days prior to the public hearing. As <br />the property was not posted, the rezoning ordinance will return to the Planning <br />Commission. He explained the public may speak on any of the documents. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />COUNCIL COMMENTS <br />Council member Loo inquired how far would the rezoning be pushed back. Planning <br />Director Russ stated there are requirements for a 15 -day publication, posting and <br />mailing for rezoning. This will be reviewed by the Planning Commission on their first <br />meeting in August and returned to the City Council at the second meeting in August. <br />Mayor Pro Tem Dalton asked if this would present a practical delay for the developer. <br />Planning Director Russ responded no and explained there is a sense of confidence from <br />the developer from a plat and PUD perspective controlled by the zoning. They cannot <br />move forward until the zoning is established. This is a preliminary PUD and nothing will <br />move forward until after the final PUD is approved. He did not believe there was an <br />impact to the overall project. <br />Planning Director Russ claimed responsibility for not posting the property and explained <br />the posting requirements are complicated. For example a PUD, SRU or a Plat does not <br />require posting, however a rezoning does require posting. The Planning Division will <br />meet next week at a study session to discuss making all posting processes consistent. <br />STAFF PRESENTATION <br />Planner I Robinson presented the facts and issues of the proposal. This is a request for <br />a Preliminary Plat and Preliminary PUD and a modification of the Louisville Municipal <br />Code. The request is for the redevelopment of a property at the southwest corner of <br />South Boulder Road and Highway 42, just north of Little Italy and east of the railroad <br />tracks. The property includes parts the Louisville Cyclery building, the former 7 -11 <br />building, and the Tim's Trains building. It does not contain Union Jack Liquor, Fordyce <br />Auto or the carwash. It does include all the vacant land between South Boulder Road <br />and Little Italy. <br />The request is for 34,335 square feet of commercial space, replacing 13,440 square <br />feet of existing commercial space for a net increase of 20,895 square feet. The request <br />includes 51 residential units: 34 as duplexes and 17 as townhomes. The property is <br />located within the Highway 42 Revitalization Area and requires rezoning to be compliant <br />with Chapter 17.14 of the Louisville Municipal Code. The applicant is requesting <br />modifications to the adopted Land Use Plan to allow for a more functional layout. The <br />proposal moves some of the commercial area from along South Boulder Road to along <br />Highway 42, providing better visibility and access. The applicant is also requesting a <br />
