<br />RESOLUTION NO. 15 <br />SERIES 2005 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE FOR OUTSIDE DINING <br />FOR THE HUCKLEBERRY RESTAURANT LOCATED AT 700 MAIN STREET. <br /> <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a special review use (SRU) for an outside dining area for the Huckleberry <br />Restaurant and Tea Room located at 700 Main Street; and, <br /> <br />WHEREAS, all materials related to the SRU have been reviewed by City Staff, the <br />Planning Commission and City Council and have been found to comply with Chapter 17 of the <br />LMC, including the SRU criteria listed in Section 17.40.100; and, <br /> <br />WHEREAS, after a duly noticed public hearing on April 14, 2005 where evidence and <br />testimony were entered into the record, including the findings in the Louisville Planning <br />Commission Staff Report of April 14, 2005 the Planning Commission recommended approval <br />to the City Council, with conditions; and, <br /> <br />WHEREAS, City Council conducted a duly noticed public hearing on May 3, 2005 <br />where evidence and testimony were entered into the record; and, <br /> <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and finds that the application should be approved, with the <br />following conditions: <br /> <br />1. The applicant shall require his employees to park in long term parking areas, and not on the <br />street or in 2-hour lots. <br />2. The applicant will remove the Locust tree adjacent to Pine Street. <br />3. The applicant shall submit a planting schedule for the landscaped areas prior to the issuance <br />of a building permit. Planting materials will be selected for their ability to screen the off- <br />street parking area. <br />4. Fencing on site shall not exceed a height of 6 feet. Additional screening on the north side of <br />the patio area may be provided by the pergola. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Louisville, Colorado does hereby approve a special review use for an outside dining area for <br />the Huckleberry Restaurant and Tea Room located at 700 Main Street <br /> <br />
