<br />RESOLUTION NO. 28 <br />SERIES 2005 <br /> <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL <br />AGREEMENT WITH THE BOULDER COUNTY CLERK AND <br />RECORDER FOR THE CONDUCT AND ADMINISTRATION OF A <br />COORDINATED MAIL BALLOT ELECTION TO BE HELD <br />NOVEMBER 1, 2005. <br /> <br />WHEREAS, the City will hold a regular municipal election on November I, 2005, as a <br />coordinated mail ballot election pursuant to the Uniform Election Code of 1992, as amended; <br />and <br /> <br />WHEREAS, the attached Contract By and Between the City of Louisville and the <br />Boulder County Clerk and Recorder for the Conduct and Administration of the Coordinated <br />Election to be held November 1, 2005 ("Intergovernmental Agreement") provides for the <br />conduct and financing of such coordinated election. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Intergovernmental Agreement, a copy of which is attached hereto <br />and incorporated herein by this reference, is hereby approved. <br /> <br />2. The City Manager and City Clerk are hereby authorized to execute the attached <br />Intergovernmental Agreement on behalf of the City of Louisville, except that such persons are <br />hereby further authorized to negotiate and approve such revisions to the Intergovernmental <br />Agreement as are determined necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Intergovernmental Agreement are not altered. <br /> <br />3. Pursuant to C.R.S. Section 31-10-102.7, the City will utilize the requirements and <br />procedures of the Uniform Election Code of 1992, articles 1 to 13 of title 1, C.R.S., as amended, <br />in lieu of the Colorado Municipal Election Code of 1965, article 10 of title 31, C.R.S., as <br />amended, with respect to the regular municipal election to be held on November 1, 2005, and <br />such election shall be conducted as part of a coordinated mail ballot election. <br /> <br /> <br />I <br />
