<br />RESOLUTION NO. 32 <br />SERIES 2005 <br /> <br />A RESOLUTION APPROVING A GRANT OF EASEMENT AND AGREEMENT FOR <br />THE CITY OF LOUISVILLE'S ELDORADO SPRINGS WATER PIPELINE <br /> <br />WHEREAS, in 1956 the City was granted an easement over certain property now owed <br />by Darrell and Patricia Laham for the installation of a portion of the City's Eldorado Springs <br />water pipeline; and <br /> <br />WHEREAS, a new Grant of Easement and Agreement has been proposed between the <br />Lahams and the City to reflect the installed location of the City's water pipeline, to allow for the <br />Owner's installation of certain improvements within the easement premises, and to address other <br />matters concerning the operation, maintenance, repair, removal and replacement of the City's <br />pipeline and improvements within the easement; and <br /> <br />WHEREAS, the City by this Resolution desires to approve the Grant of Easement and <br />Agreement and to authorize execution of such Agreement and the Quit Claim Deed to be executed <br />pursuant to such Agreement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />1. The proposed Grant of Easement and Agreement ("Agreement") between Darrell <br />Laham and Patricia Laham, as Grantor, and the City of Louisville, as Grantee, for an easement for <br />the City's Eldorado Springs water pipeline, is hereby approved in essentially the same form as the <br />copy of such Agreement accompanying this Resolution. <br /> <br />2. The Mayor and City Clerk are authorized to execute the Agreement and the Quit <br />Claim Deed to be executed pursuant to such Agreement, except that the Quit Claim Deed shall not <br />be executed until Grantor has executed and delivered the Agreement to the City, and except, <br />further, that the Mayor is hereby granted the authority to negotiate and approve such revisions to <br />said Agreement as the Mayor determines are necessary or desirable for the protection of the City, so <br />long as the essential terms and conditions of the Agreement are not altered. <br /> <br />PAS;&R,~D ADOPTED this ~ day Of~, 2005. <br />~"~: \..0 U !
