City Council <br />Meeting Minutes <br />July 16, 2013 <br />Page 20 of 25 <br />As a result, some stores in Colorado were closed. The US Attorney for the Colorado <br />District has stated any profits derived from commercial sales of marijuana will be treated <br />as illegal profits or proceeds and the business could be acted upon by the federal <br />government. <br />Mayor Muckle and Council member Loo wanted a 1000' separation from schools and <br />also favored specific zone districts. <br />Mayor Muckle did not support downtown facilities and favored other zone districts. <br />City Attorney Light explained the distance requirement for medical marijuana is 1,320'. <br />Planning Director Russ explained staff can bring forward more options. Deputy City <br />Manager Balser asked whether staff should bring these matters, with input from the <br />discussion this evening, to Planning Commission and come back with a <br />recommendation. <br />Council member Jasiak asked Chief Goodman for his experience on alcohol location <br />problems. Chief Goodman stated the police department has not had to deal with this <br />issue. He noted they have never experienced a conflict between state and federal law. <br />He stated the voters of Colorado voted for private consumption and getting the sales out <br />of the hands of law makers. He felt local governments are trying to deal with the issue <br />about separation from schools. Although he did not see any reason to have <br />recreational facilities near a school, he doubted limitations would have much effect. <br />Council member Yarnell voiced her concern over recreational marijuana facilities near a <br />park. Chief Goodman stated parks are targets for people who want to be overlooked. <br />Council member Yarnell did not support facilities near a school, daycare, parks or public <br />pools. <br />Mayor Muckle suggested the staff present the zoning issue to the Planning Commission <br />and bring forward a recommendation. <br />3. Location % Performance Criteria /Colocation: <br />A. Does Council want to outline specific location and performance standards for <br />retail marijuana sales? If so, what is Council's preference for a distance <br />requirement? <br />B. Is Council interested in specifying building size limitations? <br />C. Does the Council want to allow colocation (i.e., dual use of the same location) <br />for medical marijuana businesses and retail marijuana establishments? <br />COUNCIL COMMENTS <br />
