City Council <br />Meeting Minutes <br />July 16, 2013 <br />Page 22 of 25 <br />require certain testing of the concentration levels of THC. This process will be <br />performed in a laboratory. <br />Council member Keany and Mayor Pro Tem Dalton had no problem with any cultivation, <br />manufacturing or testing in the industrial zoning. <br />Council member Yarnell concurred with Council member Jasiak. <br />Council member Loo asked why there is an interest in cultivation and manufacturing but <br />not in testing. Council member Jasiak stated smoking marijuana is still a federal <br />offense. <br />Mayor Pro Tem Dalton stated those operations exist in Denver without interference from <br />the Federal government. Chief Goodman stated the Federal government -has closed <br />down retail grow operations but not medical marijuana operations. <br />Mayor Muckle did not see much support or benefit for the grow operations unless there <br />is an excise tax. Council member Keany was willing to yield on cultivation, but noted <br />the manufacturing and testing are viable businesses. <br />Council member Loo asked if recreational marijuana businesses are eligible for BAPS. <br />Mayor Muckle asked if manufacturing operations would generate any tax revenue. <br />Council member Keany stated use and property tax revenue would be generated. It <br />was noted commercial property tax is higher than residential property tax. <br />Council member Keariy did not support BAPS for recreational marijuana businesses. <br />Council member Jasiak stated she would be open to arguments on manufacturing more <br />so than grow operations. Mayor Muckle concurred. <br />Coordination with Medical Marijuana Regulations <br />A. Does Council want to allow changes in location of premises for retail stores and /or <br />medical marijuana stores? <br />B. May licenses be transferred incident to a conversion, or generally? <br />City Attorney Light explained the City's medical marijuana regulations are not aligned <br />with state law. Staff is requesting direction on whether the zoning laws and separation <br />requirements should manage the issue and if so, staff will prepare a draft for Council. <br />COUNCIL COMMENTS <br />There was Council support for transfers and conversions. <br />
