The applicant desires to have an application
for a grant incentive accompanying the historic landmark designation. Staff
recommended continuing the application to September 3, 2013 to allow the Historic
Preservation Commission to review the grant application.
City Attorney Light inquired if the applicant consented to the continuance. Planning
Director Russ stated the Planning Staff had conversations with the applicant about the
September 3 date to review both the grant and the landmarking.
Mayor Muckle asked if there is a deadline from the time the Historic Preservation
Commission made their recommendation. Planning Director Russ stated the
recommendation was made on the landmarking but not the grant.
City Attorney Light explained unless the applicant consents to a later date, the City
Council has 60 days from the advertised date to review the application. Planning
Director Russ stated the advertised date of the public hearing was July 2, 2013.
City Attorney Light stated to bridge the gap, the Council can continue the application to
a future meeting, and if necessary, roll the hearing over to another meeting. Planner I
Robinson requested the City Council open the public hearing and continue the public
hearing to a future Council meeting.
Mayor Muckle opened the public hearing and moved to continue hearing until August
20, 2013, seconded by Council member Keany. All were in favor.
ORDINANCE No. 1635, SERIES 2013 — AN ORDINANCE APPROVING THE
VACATION OF AN EXISTING 25 FOOT SEWER AND WATER EASEMENT
LOCATED WITHIN TRACT I, LOUISVILLE NORTH 7111 FILING WITHIN THE CITY OF
LOUISVILLE — 2ND READING — PUBLIC HEARING
Mayor Muckle requested a City Attorney introduction.
City Attorney Light read Ordinance No. 1635, Series 2013 and noted it was the second
reading of the ordinance and scheduled for a public hearing.
Mayor Muckle opened the public hearing and requested a staff presentation.
Planning Director Russ explained the City Council approved a final planned unit
development, final plat, and special review use (SRU), to redevelop the former Safeway
