<br /> <br /> <br /> <br /> <br />LOCAL LICENSING AUTHORITY <br /> <br /> <br />LOCAL LICENSING AUTHORITY MEMO <br /> AGENDA ITEM VI-C <br /> <br /> <br />SUBJECT: UPDATE/DISCUSSION/DIRECTION - REGULATION OF RETAIL <br /> MARIJUANA – SET SPECIAL MEETING FOR AUGUST 5, 2013 <br /> <br />DATE: JULY 22, 2013 <br /> <br />PRESENTED BY: CAROL HANSON, AUTHORITY SECRETARY <br /> <br />SUMMARY: <br /> <br />At the last regular meeting of City Council, discussion on the regulation of retail <br />marijuana began. Staff was given direction and will be drafting local regulations. <br /> <br />Council discussed licensing and expressed a desire to have the Local Licensing <br />Authority (LLA) issue licenses for retail marijuana. There was discussion about <br />caps on the number of licenses which could be accomplished by imposing zoning <br />and distance restrictions. Having the ability for both medical and retail marijuana in <br />the same location would be allowed following the State regulations which prohibit <br />clients under 18 years of age at a shared facility unless there are separate <br />entrances and points of sale. Council expressed concern about cultivation <br />operations and manufacturing, with some interest in allowing testing facilities. <br />Council had no objection to allowing changes in location or transfer of licenses for <br />either retail or medical marijuana. <br /> <br />The State Marijuana Enforcement Division (MED) has reported they will accept fees <br />and applications in their offices first. They will forward a copy of the application to <br />the local jurisdictions along with the local portion of the fees. They will conduct the <br />background checks and review the application. If they approve the application, <br />notice will be given to the local jurisdiction and the license will be granted only after <br />local approval. With medical marijuana, Louisville has required the background <br />checks to be repeated. At a recent roundtable with officials from MED, the State <br />reported they will be doing thorough background checks. Does LLA see a need to <br />repeat those checks at the local level? What other items does the LLA want staff to <br />consider during the drafting of the local regulations? <br /> <br />Because of the short time frame between the Council meeting and the LLA meeting <br />and draft regulations unavailable, staff asks the Authority members to consider <br />holding a special meeting on August 5, 2013 to review the draft regulations. <br /> <br />RECOMMENDATION: <br /> <br />Authority review and submit their recommendations and set special meeting for <br />August 5, 2013 at 7:00 PM in Council Chambers.
