<br /> <br /> <br /> <br /> <br />LOCAL LICENSING AUTHORITY <br /> <br /> <br />LOCAL LICENSING AUTHORITY MEMO <br /> AGENDA ITEM IV-A <br /> <br /> <br />SUBJECT: RECOMMENDATIONS AND INPUT ON AN ORDINANCE <br /> AMENDING TITLE 5 OF THE LOUISVILLE MUNICIPAL CODE <br /> TO ADOPT REGULATIONS REGARDING BUSINESS <br /> LICENSING AND OPERATIONAL REQUIREMENTS <br /> FOR RETAIL MARIJUANA ESTABLISHMENTS <br /> <br />DATE: AUGUST 5, 2013 <br /> <br />PRESENTED BY: CAROL HANSON, AUTHORITY SECRETARY <br /> <br />SUMMARY: <br /> <br />This Special Meeting of the Local Licensing Authority was called during the last <br />regular meeting to allow time for staff to draft local regulations concerning retail <br />marijuana. Staff would like the Authority’s input before forwarding to Council. <br /> <br />Attached is the proposed amendment to Title 5 for retail marijuana for Authority <br />review. The proposed changes to Title 17 are attached along with the State <br />Regulations concerning retail marijuana. <br /> <br />Particular items for Authority discussion are: <br />• Instead of charging an application fee, we will get half of the state fee ($250 for <br />conversion from Medical, $2,500 for new) <br />• The amount of the operating fee and establishing it by resolution (the Local <br />Licensing Authority indicated at the last meeting this should be determined by <br />staff) <br />• No background checks for employees, just owners and managers – this is how <br />the State regulations are written <br />• Should there be a required minimum age for employees <br />• Should building inspections be done before stores open. <br />• Do we want some way to limit concentration, such as a cap within an area <br />• Do we want to list anything specific in the prohibited acts section <br />• Is there a need for some kind of surety bond to guarantee tax payment <br /> <br />RECOMMENDATION: <br /> <br />Authority review and submit their recommendations.
