ORDINANCE NO. 1637, SERIES 2013 — AN ORDINANCE AMENDING CHAPTER 17.14 OF THE LOUISVILLE MUNICIPAL CODE TO ALLOW FOR A LAYOUT MODIFICATION TO MODIFY THE LAND USE PLAN INCORPORATED AS "EXHIBIT A" Mayor Muckle moved to approve Ordinance No. 1637, Series 2013 on first reading, ordered it published and set a public hearing for August 20, 2013, seconded by Council member Loo. All were in favor. ORDINANCE NO. 1638, SERIES 2013 — AN ORDINANCE APPROVING A REZONING OF A 4.3 -ACRE PARCEL OF LAND FROM CITY OF LOUISVILLE INDUSTRIAL (I) ZONING TO CITIY OF LOUISVILLE MIXED -USE RESIDENTIAL (MU -R) Mayor Muckle moved to approve Ordinance No. 1638, Series 2013 . on first reading, ordered it published and set a public hearing for August 20, 2013, seconded by Council member Sackett. All were in favor. RESOLUTION NO. 42, SERIES 2013 — A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU), REZONING, PRELIMINARY SUBDIVISION PLAT, PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD), AND AMENDMENTS TO CHAPTER 17.14 OF THE LOUISVILLE MUNICIPAL CODE FOR AN APPROXIMATE 14.13 ACRE PARCEL OF THE INDUSTRIAL AREA AND CALEDONIA PLACE SUBDIVISIONS. THE INTENT OF THE REQUEST IS TO DEVELOP THE PROPERTY WITH 244 RESIDENTIAL UNITS AND 12,000 SQUARE FEET OF COMMERCIAL SPACE PUBLIC COMMENT John Leary, 1116 LaFarge Avenue, Louisville, CO, voiced his concerns with Resolution No. 41. He believed certain information was withheld from the Planning Commission. He felt the resolution establishes policy over the land dedication of a major replat. He stated this development of 244 residential units will put a significant number of people into the parks system. He stated this could be the most expensive development the City has ever had because of the public financial commitment. He questioned the proposal for a mixed -use development and the estimate of sales tax. He noted in most developments the developer pays for the infrastructure, but this project requires the public to subsidize the improvements. MOTION: Mayor Muckle moved to continue Resolution No. 41, Series 2013 to August 20, 2013, and to incorporate Mr. Leary's comments into the record, seconded by Mayor Pro Tem Dalton. All were in favor.
