ORDINANCE NO. 1638, SERIES 2013 — AN ORDINANCE APPROVING <br />A REZONING OF A 4.3 -ACRE PARCEL OF LAND FROM CITY OF <br />LOUISVILLE INDUSTRIAL (I) ZONING TO CITY OF LOUISVILLE <br />MIXED -USE RESIDENTIAL (MU -R) — PUBLIC HEARING 8/20/13 <br />3. RESOLUTION NO. 42, SERIES 2013 — A RESOLUTION APPROVING A <br />SPECIAL REVIEW USE (SRU), REZONING, PRELIMINARY <br />SUBDIVISION PLAT, PRELIMINARY PLANNED UNIT DEVELOPMENT <br />(PUD), AND AMENDMENTS TO CHAPTER 17.14 OF THE LOUISVILLE <br />MUNICIPAL CODE FOR AN APPROXIMATE 14.18 ACRE PARCEL OF <br />THE INDUSTRIAL AREA AND CALEDONIA PLACE SUBDIVISIONS. <br />THE INTENT OF THE REQUEST IS TO DEVELOP THE PROPERTY <br />WITH 244 RESIDENTIAL UNITS AND 12,000 SQUARE FEET OF <br />COMMERCIAL SPACE — CONTINUED FROM 8/06/13 <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light read Ordinance No. 1637, Series 2013 and Ordinance No. 1638, <br />Series 2013 and Resolution No. 42, Series 2013, for a Preliminary Special Review Use, <br />a Preliminary Plat, and a Preliminary PUD. Staff will make a presentation on all three <br />agenda items and the public may speak to any of the three agenda items. He requested <br />separate motions on each agenda item. <br />Mayor Muckle opened the public hearing and requested all the emails received on this <br />matter and the comments made by Mr. Leary at the August 6, 2013 meeting be <br />incorporated into the record. He requested a staff presentation. <br />Planning Director Russ noted there are also modifications to Ordinance No. 1638, <br />Series 2013. His presentation would include a Preliminary Special Review Use, a <br />Preliminary Plat, and a Preliminary PUD. The Special Review Use is preliminary. An <br />SRU can only be approved at final submittal. Additionally there is a request to modify <br />the Land Use Plan and to rezone the 14.13 -acre parcel from Industrial to Mixed -Use <br />Residential. <br />The property is located east of the downtown area, between South and Griffith Streets, <br />east of the BNSF railway and west of Cannon Street. The Comcast property is located <br />within the parcel, but is not proposed for rezoning. The Preliminary Plat, Special <br />Review Use and Preliminary PUD represent the basic site plan; density; bulk and mass <br />of buildings, but not the architectural details. The regulatory documents to review this <br />proposal included the Louisville Municipal Code and the Mixed -Use Design Guidelines. <br />
