take any action appropriate to compel payment of appropriated funds. When subsequent year budgets are <br />available for years 2015 -2018, each Municipality shall consider the appropriation of funds. <br />F. If, during any year this Agreement is in effect, either the community participation level in a <br />community is expected to exceed projections, thereby raising the Party's percentage of contribution, or <br />operating costs for the HMM Facility will exceed the original estimates such that a Party's obligation for <br />operating expenses during the calendar year will exceed the amount appropriated for such year, the Party <br />affected by such increase may take either of the following actions or some combination thereof: <br />1. The Party may appropriate additional funds to support such additional participation by its <br />residents. <br />2. The Party may choose not to appropriate additional funds and request that the County <br />restrict use by its residents so as not to exceed the funding appropriated. <br />G. In the event that HMM Program operating costs are expected to be higher than anticipated, the <br />HMM Committee may recommend appropriate action to help reduce the costs of operating of the HMM <br />Facility, such as recommending that Boulder County staff reduce the hours of operation. <br />H. In the event that one or more of the Parties fails to contribute its share of costs, and in a manner <br />consistent with this Agreement, the Party in default will refrain from further participation in the HMM <br />Program, its residents will not be permitted to bring Hazardous Wastes to the HMM Facility and its rights <br />pursuant to this Agreement shall be suspended, but the terms and obligations of this Agreement will <br />continue for the remaining Parties, and any of the remaining Parties may take appropriate action to <br />enforce this Agreement. <br />I. In the event that one or more Municipalities fail to ratify this Agreement or initially ratify this <br />Agreement and thereafter default, the remaining Parties reserve the right, following suspension of the <br />Party or Parties in default, to re- estimate the cost of the HMM Program in consultation with the <br />Hazardous Waste, Waste and Recycling Contractors and to adjust each Party's funding allocation on a <br />pro -rated basis to total 100% of the revised cost. <br />J. If this Agreement is extended beyond 2018, the HMM Committee shall consider past usage of <br />each .participating community to evaluate methods of pro- rating costs, and make recommendations to the <br />Parties. <br />VI. PAYMENT OF ANNUAL OPERATING EXPENSES <br />A. The County will be the paying agent for the HMM Program and Facility. <br />B. The County will request payment of each Party's contribution to HMM Program costs based on <br />the participation by households of each Party, on a quarterly basis. Contributions will be based on the <br />previous quarter's operation. Each Municipality will pay its contribution within 30 days of billing. <br />C. Each Municipality's payment obligations hereunder are subject to and limited by the <br />appropriation of sufficient funds for each year this Agreement is in effect. <br />VII. FUNDING FOR CONSTRUCTION OF THE HAZARDOUS MATERIALS MANAGEMENT <br />FACILITY <br />A. Boulder County finished construction of the 1-IMM Facility in 2011 on County -owned property <br />located at 1901 63`d Street, Boulder, the same site occupied by the Boulder County Recycling Center.
