Section 2. Section 5.10.130.0 of the Louisville Municipal Code is hereby <br />amended to read as follows (words, to be added are underlined; words to be <br />deleted are stricken through): <br />Sec. 5.10.130. Change in manager, employee; change <br />financial interest; modification of premises. <br />C. For a transfer of ownership, Any transfer or change of <br />financial interest in the license holder shall apply to the local <br />licensing authority. In determining whether to permit a transfer of <br />ownership, the local licensing authority shall consider only the <br />suitability of the applicant pursuant to this Chapter 5.10, C.R.S. § 12- <br />43.4 -101, et seq., and any related rules and regulations, as from time <br />to time amended. The local licensing authority may hold a hearing <br />on the transfer application; provided the local licensing authority shall <br />not hold a hearing until notice has been posted and provided to the <br />applicant in accordance with the requirements of C.R.S. § 12 -43.3- <br />309. <br />license. <br />Section 3. If any portion of this ordinance is held to be invalid for any <br />reason such decisions shall not affect the validity of the remaining portions of this <br />ordinance The City Council hereby declares that it would have passed this <br />ordinance and each part hereof irrespective of the fact that anyone part be <br />declared invalid. <br />Section 4. The repeal or modification of any provision of the Municipal <br />Code of the City of Louisville by this ordinance shall not release, extinguish, alter, <br />modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and each provision <br />shall be treated and held as still remaining in force for the purpose of sustaining any <br />and all proper actions, suits, proceedings, and prosecutions for the enforcement of <br />the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such <br />actions, suits, proceedings, or prosecutions. <br />Section 5. All other ordinances or portions thereof inconsistent or <br />conflicting with this ordinance or any portions hereof are hereby repealed to the <br />extent of such inconsistency or conflict. <br />Ordinance No. 1642, Series 2013 <br />Page 2 of 3 <br />
