S. Prior to the recordation of the subdivision plat the CTC Metro District shall convey the <br />required additional right -of -way for So.104`h Street and secure the associated public <br />improvements through the CTC Filing No. 2 Subdivision Agreement. If the District is <br />unable to fulfill this condition, then the Subdivider shall be required to fulfill the required <br />condition prior to the recordation of the subdivision plat. <br />6. Prior to plat recordation, the Subdivider shall comply with the public use dedication <br />requirement through a combination of land dedication and cash -in -lieu payments as <br />outlined in applicant's letter of January 21, 2003. The final terms thereof shall be set <br />forth in the Subdivision Agreement. <br />7. The 15 foot Drainage, Utility and Landscape along CTC Boulevard and Boxelder Street <br />are intended to carry and contain surface flows of off -site storm drainage. As such, the <br />grading and landscape materials proposed in the easement will be subject to specific <br />review and approval by the City's Public Works Engineering Division.
