<br />AN ORDINANCE APPROVING THE VACATION OF A 10-FOOT BY 125-FOOT ALLEY
<br />RIGHT-OF-WAY LYING BETWEEN LOT 6, BLOCK ONE AND LOTS 1-5, BLOCK
<br />ONE, JEFFERSON PLACE SUBDIVISION IN THE CITY OF LOUISVILLE
<br />WHEREAS, by the plat of Jefferson Place Subdivision, recorded December 27, 1880, in
<br />Plat Book 2 at Page 9, Boulder County Records, there was dedicated to the City a 10-foot wide by
<br />125-foot long right-of--way for aneast-west alley lying between the north property line of Lot 6,
<br />Block One, Jefferson Place Subdivision and the south property lines of Lot 1-5, Block One,
<br />Jefferson Place Subdivision, which 1,250 square-foot area is hereafter referred to as the "Alley
<br />Right-of-Way"; and
<br />WHEREAS, proper application has been made to the City for vacation of the Alley Right-
<br />of-Way; and
<br />WHEREAS, the City Council has determined that the Alley Right-of--Way for which
<br />vacation has been requested is not anal has not been used or required as a roadway or thoroughfare
<br />for the public; and
<br />WHEREAS, the City Council has determined that the Alley Right-of--Way for which
<br />vacation is requested is not and will not be needed for any public purposes other than for the
<br />operation, maintenance, repair, and replacement of public utilities; and
<br />WHEREAS, the City Council has determined that the Alley Right-of--Way for which
<br />vacation is requested is not being used or held for park purposes or for any other governmental
<br />purposes; and
<br />WHEREAS, the City Council desires to approve the application and vacate the City's
<br />interests in the Alley Right-of--Way described herein for which vacation is requested, subject to the
<br />reservation of easements for public utilities and to the other provisions of this Ordinance;
<br />NOW, THEREFORE, BE I'T ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF LOUISVILLE, COLORADO:
<br />Sect_ Subject to the provisions of Sections 2 and 3 hereof, the City hereby vacates
<br />that certain 10-foot wide by 125-foot long alley right-of--way, running east-west and lying between
<br />the north properly line of Lot 6, Block One, Jefferson Place Subdivision and the south property
<br />lines of Lot 1-5, Block One, Jefferson Place Subdivision, City of Louisville, Boulder County,
<br />Colorado, which 1,250 square-foot gel ve tin the manner provided by alWey Right-of-Way". Title
<br />to the vacated Alley Right-of--Way shal
<br />Section 2. Easements are; hereby reserved under, over, through and across the Alley
<br />Right-of--Way for the installation, operation, maintenance, repair, upgrading and replacement of
<br />existing and future public utilities. Further, easements for existing public utilities, if any, shall not
