ul^YII~IIYIYIINIIIIIII m0]M535 3 <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT is made this seventeenth day of July, 2007, by <br />and between the City of Louisville, a Colorado municipal corporation, whose address is <br />749 Main Street, Louisville, Cclorado, 80027 (hereinafter "Grantor") and 628 LaFarge <br />Avenue LLC, whose address is 2390 Vassar Drive, Louisville, Colorado, 80305 <br />(hereinafter "Grantee"). <br />WITNESSETH: <br />THAT THE GRANTOl3, for and in consideration of the sum of Ten Dollars paid <br />to the Grantor by the Grantee, and other good and valuable consideration, the receipt and <br />sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell and com~ey <br />unto the Grantee a perpetual and. non-exclusive Easement to operate, maintain, repair, and <br />replace an existing private sanitary sewer line and appurtenances and related improvements, <br />such Easement being on, over, under and across the real property described as follows: <br />A 10-foot wide by 125-fi~ot long alley right-of--way, running east-west and <br />lying between the north property line of Lot 6, Block One, Jefferson Place <br />Subdivision and the soutYl property lines of Lot 1 - 5, Block One, Jefferson <br />Place Subdivision, City of Louisville, Boulder County, Colorado (the <br />"Property"), . <br />consisting of approximately 1,250 square feet; <br />TOGETHER WITH all the rights and privileges as are necessary or incidental to <br />the reasonable and proper use of such Easement; and <br />SUBJECT TO the following terms and conditions: <br />1. This Easement shall be subordinate, subject and inferior to the Grantor's <br />reservation of an easement under, over, through and across the Property for <br />existing and future public utilities, as set forth in City of Louisville <br />Ordinance No. 1523, Series 2007, passed and adopted on July 17, 2007. <br />2. Grantor shall not place, erect or construct, or allow to be placed, erected or <br />constructed on the Easement area any equipment or structure or other <br />improvement whatsoever which may interfere with the Grantee's full use and <br />enjoyment of the rights hereunder. <br />3. Insofar as practicable, and to the extent not occupied by the appurtenances <br />and related improvements permitted hereunder, the Grantee shall restore the <br />surface of the Easement area to the condition that existed immediately prior <br />to the commencement of any surface disturbing activities permitted <br />hereunder. <br /> <br />
