II IIIIIIIIIIIIII Page: 1 of 56 <br />IIIIIIIIIIIIIIII z~~~~~~ <br />IIIIII IIIVIIIII <br />IIIIII <br />11!06/2007 03.52P <br />Boulder County Clerk, CO ORD R 281.00 D 0.00 <br />ORDINANCE NO. 1524 <br />SERIES 2007 <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT A <br />NEW CHAPTER 17.14 ENACTING 11AIXED USE ZONE DISTRICT REGULATIONS; TO ADOPT <br />AND INCORPORATE INTO TITLE: 17 THE CITY OF LOUISVILLE MIXED USE DESIGN <br />STANDARDS AND GUIDELINES, AND TO ADOPT CERTAIN OTHER AMENDMENTS TO <br />TITLE 17 TO IMPLEMENT THE HIIGHWAY 42 REVITALIZATION AREA COMPREHENSIVE <br />PLAN <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br />organized and existing under laws oii the State of Colorado and the City Charter; and <br />WHEREAS, pursuant to such home rule authority and state law, including but not limited to <br />C.R.S. §§ 24-67-101 et sec ., 29-20-101 et sec .., 31-23-201 et sec .. and 31-23-301 et seq., the City <br />is empowered to adopt procedures and standards pertaining to planned unit developments <br />(PUDs); to establish zoning districts and zone district regulations within the City for the purpose of, <br />among other things, promoting the gieneral welfare of the inhabitants of the City; and to regulate <br />and restrict, among other things, the size of buildings and other structures; the percentage of lot <br />that may be occupied; the size of yards, courts, and other open spaces; the density of population; <br />and the location and use of buildings, structures, and land for trade, industry, residence, or other <br />purposes; and <br />WHEREAS, the City has developed and established, and continues to develop and <br />establish, development design standards and guidelines for development within the City; and <br />WHEREAS, the City in September 2003 adopted the Highway 42 Revitalization Area Plan, <br />which sub-area plan is incorporated into the 2005 Citywide Comprehensive Plan adopted in August <br />2005; and <br />WHEREAS, a primary recorrimendation of the plan is the adoption of a mixed use zoning <br />district and associated design standards to implement the land use and urban design <br />recommendations of the plan; and <br />WHEREAS, the City Council by this ordinance desires to amend Title 17 of the Louisville <br />Municipal Code to establish a mixed! use zoning district and associated regulations; to adopt and <br />incorporate into Title 17 the City of Louisville Mixed Use Design Standards and Guidelines, and to <br />adopt certain amendments to implement the plan; and <br />WHEREAS, the City Council finds that the amendments set forth herein will help foster <br />beneficial development with the pl<~n area and are consistent with and in furtherance of the <br />Citywide Comprehensive Plan 2005 Update and the Highway 42 Revitalization Area <br />Comprehensive Plan; and <br />..WHEREAS, the Louisville Planning Commission, after notice by publication and a public <br />hearing, has recommended the City Council approve the amendments set forth in this ordinance; <br />and <br />WHEREAS, City Council has provided notice of a public hearing on said ordinance by <br />publication as provided by law and held a public hearing as provided in said notice; <br />Coy-7`~ ii~t- <br />
