Section 2. The sale and conveyance of Property shall be upon the terms and conditions <br />set forth in that certain Contract to 13uy and Sell Real Estate between the City and the Purchaser, <br />which Contract was approved by City Council Resolution No. 59, Series 2007 (the "Purchase <br />Contract"), and which terms and conditions are incorporated herein by reference as though set forth <br />in full. <br />Section 3. The City Council hereby further approves and authorizes the sale and <br />conveyance of the Property from the City to a buyer other than the buyer under the Purchase <br />Contract for a price of not less than. $490,000 in the event such higher price is obtained and the <br />buyer under the Purchase Contract does not waive the conditions under the Purchase Contract and <br />proceed to purchase the Property; and further provided that any sale of the Property to another buyer <br />shall be upon terms and conditions that are substantially similar to those set forth in the Purchase <br />Contract, and pursuant to a contract approved by City Council resolution. <br />Section 4. If any portion. of this ordinance is held to be invalid for any reason, such <br />decisions shall not affect the validity of the remaining portions of this ordinance.
