RESOLUTION NO. 50 <br /> SERIES 2013 <br /> A RESOLUTION DESIGNATING THE LOUISVILLE LOCAL LICENSING AUTHORITY AS <br /> THE ENTITY RESPONSIBLE FOR PROCESSING APPLICATIONS FOR LICENSES FOR <br /> RETAIL MARIJUANA PRODUCTS MANUFACTURING FACILITIES, RETAIL MARIJUANA <br /> STORES, AND RETAIL MARIJUANA TESTING FACILITIES <br /> WHEREAS, Article XVIII, Section 16 of the Colorado Constitution, referred to as <br /> Amendment 64, was approved by Colorado voters in November 2012; and <br /> WHEREAS, Section (5)(e) of Amendment 64 provides: <br /> Not later than October 1, 2013, each locality shall enact an ordinance or <br /> regulation specifying the entity within the locality that is responsible for <br /> processing applications submitted for a license to operate a marijuana <br /> establishment within the boundaries of the locality and for the issuance of such <br /> licenses should the issuance by the locality become necessary because of a <br /> failure by the Department to adopt regulations pursuant to paragraph (a) or <br /> because of a failure by the Department to process and issue licenses as required <br /> by paragraph (g). <br /> WHEREAS, the Governor on May 28, 2013 signed into law House Bill 13-1317 enacting <br /> Title 12, Article 43.4 (the "Colorado Retail Marijuana Code"), which regulates the cultivation, <br /> manufacture, distribution and sale of retail marijuana; and <br /> WHEREAS, the City Council is in the process of considering a series of ordinances that <br /> will allow retail marijuana products manufacturing facilities, retail marijuana stores, and retail <br /> marijuana testing facilities as permitted land uses and will establish local licensing standards <br /> and regulations governing the time, place, manner and number of retail marijuana <br /> establishments within the City as authorized in Amendment 64 and HB 13-1317; and <br /> WHEREAS, said ordinances are not expected to be effective by October 1, 2013; and <br /> WHEREAS, for the purposes of meeting the requirements of Section 5(e) of Amendment <br /> 64, the City Council desires to specify the entity within the City that is responsible for processing <br /> applications submitted for licenses to operate marijuana establishments within the boundaries of <br /> the City and for the issuance of such licenses; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> LOUISVILLE, COLORADO: <br /> Section 1. For the purposes of meeting the requirements of Section 5(e) of <br /> Amendment 64, the City Council hereby designates the Louisville Local Licensing Authority, <br /> previously established pursuant to Chapter 5.08 of the Louisville Municipal Code, as the entity <br /> within the City that is responsible for processing applications submitted for licenses to operate <br /> retail marijuana products manufacturing facilities, retail marijuana stores, and retail marijuana <br /> testing facilities within the boundaries of the City and for the issuance of such licenses. The <br /> Louisville Local Licensing Authority shall process applications for licenses for retail marijuana <br /> Resolution No. 50, Series 2013 <br /> Page 1 of 2 <br />
