<br />WHEREAS, the City Council of the City of Louisville believes <br />that good schools are a fundamental requirement for the economic <br />well being of the area and contribute to the quality of life of all <br />Louisville residents; and <br /> <br />WHEREAS, the City Council for nearly two years has been urging <br />the School District to take the actions necessary to assure that <br />children residing in Louisville and the School District have <br />adequate school facilities; and <br /> <br />WHEREAS, the City Council supports the concept of school <br />impact fees and is willing to impose such a fee on the construction <br />of new residential dwellings subject to certain conditions; and <br /> <br />WHEREAS, the City Council believes that the citizens of <br />Louisville should be given an opportunity to express their opinion <br />on the imposition within Louisville of a school impact fee by vote <br />at the upcoming November 2, 1993 City election, even though such <br />vote is not required in order for the City to impose a school <br />impact fee. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The City Council of the City of Louisville is <br />willing to adopt a school impact fee applicable to new residential <br />dwelling units subject to the following conditions, and such other <br />condi tions as the City Council may in the future decide are <br />necessary or appropriate: <br /> <br />a. Year-round schools must not be imposed wi thin Louisville, <br />unless they are imposed District-wide at the same time. <br /> <br />b, The school impact fee in Louisville must be phased in <br />over a period of three to four years, at no more than $1,500 per <br />year, <br /> <br />c. Within one year of the effective date of Louisville's <br />school impact fee, Boulder County and all municipalities within the <br />School District must impose a similar fee, or develop and implement <br />some other alternative source of comparable funding to the School <br />District. <br /> <br />d, The School District must expend the school impact fees <br />collected within Louisville for the acquisition, construction, <br />expansion, and equipping of school facilities which will benefit <br />the Louisville residences from which the school impact fees are <br />collected, <br /> <br />2 <br />
