<br />5.08.090 Officers; Bylaws. <br /> <br />A. The authority shall elect annually from its <br />membership a chairperson and such other officers as <br />may be required. <br /> <br />B. Bylaws shall be adopted by the authority which <br />shall be consistent with this Code and applicable <br />state law. A copy of the bylaws shall be filed <br />with the city council immediately after adoption by <br />the authority, and shall be subject to the approval <br />of the city council. <br /> <br />5.08.100 Meetings; Minutes; Annual Report. <br /> <br />A. The authority shall establish a regular meeting <br />schedule which shall include at least one regular <br />meeting per month, unless cancelled for lack of <br />need. <br /> <br />B. Three members of the authority shall constitute a <br />quorum, and a decision of the majority of those <br />present shall control, provided a quorum exists. <br /> <br />C. Minutes shall be kept for each authority meeting <br />and shall be filed with the city clerk. <br /> <br />D. On or before January 31 of each year, the authority <br />shall file a report with the city council setting <br />forth the number of applications for licenses acted <br />upon, the number of licenses granted and the number <br />denied, and any other actions taken by the <br />authority during the past year. <br /> <br />5.08.110 Legal advisor; Appeals. <br /> <br />The city attorney shall be the legal advisor to the <br />authority and shall represent the authority and the city <br />in all proceedings before the authority and in all courts <br />where any decision of the authority is appealed. All <br />appeals from the local licensing authority shall be <br />directly to the District Court. <br /> <br />5.08.120 Secretary to the Authority. <br /> <br />The deputy city clerk shall serve as secretary to <br />the authority and shall receive all applications for <br />licenses and shall issue all licenses granted by the <br />authority.
