<br />conditions that have occurred since the final <br />plat was approved or by changes in the <br />development policy of the community. <br /> <br />Section 6. The Louisville Municipal Code is amended by the <br />addition of a new Section 17.28.240 to read as follows: <br /> <br />17.28.240 Expedited PUD procedure. <br /> <br />A. An applicant may request expedited review of a <br />planned unit development application upon submittal <br />of all applications and information required in <br />this title for consideration of a planned unit <br />development. The requirement of filing a <br />preliminary planned unit development plan and <br />holding a public hearing thereon is waived under <br />this expedited PUD procedure. Review of a planned <br />unit development meeting the criteria for expedited <br />review shall be conducted by the planning <br />commission and the city council under the <br />procedures authorized for final plan approval. <br /> <br />B. A planned unit development application meeting all <br />of the following criteria shall be eligible for <br />expedited review: <br /> <br />1. The property is a minimum of one (1) and no <br />more than seven (7) acres in area; <br /> <br />2. The property has been previously subdivided; <br /> <br />3. The property is governed by an approved <br />general development plan as part of a planned <br />community zone district; <br /> <br />4. The proposed planned unit development contains <br />no more than one building and principal use; <br />and, <br /> <br />5. The property is subject to covenants of record <br />addressing the use and development of the <br />property. <br /> <br />Section 7. The repeal or modification of any provision of the <br />Municipal Code of the City of Louisville by this ordinance shall <br />not release, extinguish, alter, modify, or change in whole or in <br />part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and <br />each provision shall be treated and held as still remaining in <br />force for the purpose of sustaining any and all proper actions, <br />suits, proceedings, and prosecutions for the enforcement of the <br />penalty, forfeiture, or liability, as well as for the purpose of <br /> <br />5 <br />
