<br />3.-;l <br /> <br />WHEREAS, the City has the power and authority to acquire the <br />property through condemnation or eminent domain pursuant to the <br />power and authority granted to it by statute, including without <br />limitation, the power and authority granted to pursuant to Title 31 <br />and Title 38 of the Colorado Revised statutes. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO, THAT: <br /> <br />Section 1. The acquisition of the property described as <br />Lot 1, Block 8, Heritage Subdivision Filing No.2 is necessary for <br />open space, park and recreational purposes and for the benefit of <br />the public health, safety, convenience, and welfare. <br /> <br />Section 2. The City Administrator or their designee is <br />hereby authorized to negotiate for the acquisition of said property <br />on behalf of the City. <br /> <br />Section 3. The City Administrator or their designee is <br />authorized to employ an independent appraiser to prepare an <br />appraisal of the fair market value of said property and to employ <br />such other persons that may be necessary for the acquisition of <br />said property. <br /> <br />section... The City Attorney and such other counsel as may <br />be retained by the City to act on the city's behalf are hereby <br />authorized to commence eminent domain proceedings before any Court <br />having competent jurisdiction to acquire said property in the event <br />that the City is unable to acquire said property through <br />negotiation, including applying for immediate possession of said <br />property. <br /> <br />Section 5. The action of the City in acquiring said <br />property through negotiation or through its exercise of <br />condemnation or eminent domain is necessary for the protection of <br />the health, safety, convenience, and welfare of its citizens. <br /> <br />section 6.
