<br />AND OTHERWISE ENHANCE THE PUBLIC LIBRARY SYSTEM, TO <br />CONSTRUCT, ENLARGE, AND OTHERWISE ENHANCE THE POLICE <br />ADMINISTRATION FACILITY, to the repair or installation of <br />sidewalks and curbs, street repair, street overlay or <br />seal coating, the construction of drainage improvements, <br />and the construction of other capital improvements as <br />approved specifically by the city council. It io ~greed <br />th~t up UP to fifty-five cents per square foot of the <br />capital improvement fee collected may be used to help <br />defray the expenses of the departments of finance, <br />community oervice3 PARKS AND RECREATION, community <br />development, public works and city administration <br />REASONABLY INCURRED IN CONNECTION WITH AND EQUITABLY <br />APPORTIONED TO THE CONSTRUCTION AND ACQUISITION OF THE <br />CAPITAL IMPROVEMENTS PURSUANT TO THIS CHAPTER AND THE <br />COST OF ACCOUNTING AND MANAGEMENT OF THE CAPITAL <br />IMPROVEMENT FEE AND FUND, with such portion of the fee <br />being deposited into the gener~l APPROPRIATE fund of the <br />city to help defray such expenses. <br /> <br />Section 3. Section 16.16.060, entitled "Public sites and <br />dedications", Subsection B, is amended to read as follows (words to <br />be deleted are stricken through; words to be added appear in <br />capital letters): <br /> <br />16.16.060 PUblic sites and dedications. <br /> <br />B. Public use dedications shall be as follows: <br /> <br />1. A minimum of twelve percent FOR NON- <br />RESIDENTIAL SUBDIVISIONS AND A MINIMUM OF <br />FIFTEEN PERCENT FOR RESIDENTIAL SUBDIVISIONS <br />of the total land area of the tract being <br />subdivided shall be dedicated, exclusive of <br />subsection A of this section, for park, <br />school, or other public purposes as determined <br />by the city council and shall be delineated on <br />the final plat. Land dedicated for public use <br />must be suitable, as determined by the <br />planning commission, for the type of <br />development and/or the use for which it is <br />intended. <br /> <br />2. If the city council so determines, the <br />subdivider shall pay to the city in cash an <br />amount equal to t\:el ve percent THE APPLICABLE <br />PERCENTAGE ESTABLISHED IN PARAGRAPH 1 of the <br />total appraised value of the land to be <br />subdivided in lieu of the dedication of land <br />required herein. Any appraisal required to <br />establish the value of land herein shall be <br />done at the expense of the subdivider. <br /> <br />3 <br />
