Enclave Circ, Lauisvitk CoThrado 80027 <br />303-666-7660 <br />November 7, 2013 <br />Board of Adjustment <br />Department of Planning and Building Safety <br />City of Louisville <br />749 Main Street <br />Louisville, CO 80027 <br />Dear Members of the Board of Adjustment, <br />The purpose of this letter is to request a variance for the newly built home located at 169 S. <br />Roosevelt Ave., Louisville, Colorado in order to obtain approval for a Certificate of Occupancy. <br />We apologize because during the construction process, we failed to obtain wet stamp verification. <br />At the time of completion of the construction of the home, the Certificate of Occupancy was not <br />granted because an error occurred in that the home was not set back far enough in accordance <br />with code regulations. However, the City of Louisville continued to allow the construction <br />process to proceed until completion. It was not until this point in time, in requesting the <br />Certificate of Occupancy that we became aware on our part that the building was not set back <br />properly. The undue hardship is that we cannot move the home to comply with the 25 foot <br />setback requirement (the setback of the house is presently at 23.5 feet). Further, we feel that the <br />variance, if granted, will not alter the essential character of the neighborhood in which the <br />property is located, nor substantially or permanently impair the appropriate use or development <br />of adjacent property. In fact, the house itself was built intentionally to be similar to the existing <br />homes in order to maintain the character of the existing neighborhood. In addition, we feel that <br />the variance, if granted, is a minimum variance that will afford relief and is the least modification <br />possible of the provisions of this title (Louisville zoning code) which are in question. The <br />setback deficiency of 1.5 feet at an error rate of 6% is not deemed to impact the land use and <br />surrounding properties as they currently exists. The three remaining criteria for the zoning <br />variance to be granted did not seem applicable and are not addressed in this letter. Please allow a <br />variance to the requirement and approval of the Certificate of Occupancy.
