Davidson stated that the Approval of Memorandum of Understanding with Superior Regarding McCaslin Interchange Agreement would be removed from the Consent Agenda and discussed under Council business as Agenda Item I. MOTION: Davidson moved that Council approve the consent agenda, as amended, seconded by Levihn. All in favor. Keany absent. Approval of Bills Approval of Minutes (8/6/02) PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA Jay Berger, 1016 Main Street, Louisville, CO, stated that he received a notice of a public hearing from the Planning Department concerning changes to one of the buildings are Front Street. He stressed that the notice did not indicate the issue before the Planning Commission. He suggested that notices include a brief description of the issue to be discussed at the public hearing. Davidson agreed and asked Planning Director Wood to look into the matter. COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS NOT ON THE AGENDA None. REGULAR BUSINESS ORDINANCE NO. 1396 SERIES 2002 - AN ORDINANCE REPEALING AND REENACTING CHAPTER 8.56 OF THE LOUISVILLE MUNICIPAL CODE, ENTITLED "SMOKING IN PUBLIC PLACES PROHIBITED, AND INCLUDING PROVISIONS TO PROHIBIT SMOKING IN INDOOR PUBLIC PLACES AND OUTDOOR EATING AREAS - 2nd reading - public hearing (advertised in the Daily Camera 08/10/02) Levihn recused himself from the discussion and vote on the smoking ordinance. He explained that he is an officer with the Tri-City Elks Club. Davidson asked that the record reflect that Council member Levihn was excused from the discussion and vote of Ordinance No. 1396, Series 2002. Davidson called for City Attorney introduction. 2
