<br />1-:3 <br /> <br />of life and property, and the same is hereby <br />declared to be a public nuisance and a violation of <br />this Section. <br /> <br />B. No summons and complaint shall be issued unless <br />there is a complaining witness who has signed such <br />complaint or unless an animal control officer or <br />police officer has personally witnessed the alleged <br />annoying behavior of the animal complained of and <br />will so testify at trial. <br /> <br />C. Any animal control officer or police officer shall <br />have the authority to use all reasonable means to <br />abate any nuisance described in this Section, <br />including but not limited to requiring that the <br />owner or other person in control of the animal make <br />bona fide efforts to quiet the animal and <br />impoundment of the animal if the owner is absent <br />from the premises. <br /> <br />Section 3. Section 6.08.010 of the Louisville Municipal <br />Code is repealed and reenacted, with amendments, to read: <br /> <br />6.08.010 Cruelty to animals prohibited. <br /> <br />It is unlawful for any person, except as authorized <br />by law, to knowingly or with criminal negligence <br />overdrive, overload, overwork, torture, torment, deprive <br />of necessary sustenance, unnecessarily or cruelly beat, <br />needlessly mutilate, needlessly kill, carry or confine in <br />or upon any vehicle in a cruel or reckless manner, or <br />otherwise mistreat or neglect any animal, or cause or <br />procure it to be done, or, having the charge or custody <br />of any animal, fail to provide it with proper food, <br />drink, or protection from the weather, or abandon it. <br /> <br />Section 4. Sections 6.12.010, 6.16.010, and 6.20.010 of <br />the Louisville Municipal Code are repealed and reenacted, with <br />amendments, to read: <br /> <br />6.12.010 Running at large prohibited. <br /> <br />A. It is unlawful for the owner of a dog to permit the <br />dog to run at large within the city. <br /> <br />B. It is unlawful for the owner of any unspayed female <br />cat in the state of estrus (heat) to permit such <br />cat to run at large within the city. <br /> <br />C. It is unlawful for the owner of any cow, horse, <br />mule, sheep, swine, goat or domestic fowl to permit <br />such animal or fowl to run at large in the city. <br /> <br />3 <br />
