<br />6. Raccoons, porcupines, skunks, badgers or other <br />like species, except ferrets (mustela furo); <br /> <br />7. Raptors; or <br /> <br />8. Foxes, wolves, or coyotes, including any <br />hybrid between dogs and wolves or between dogs <br />and coyotes. <br /> <br />B. The provisions of Subsection A shall not be <br />applicable to any bona fide zoological garden, any <br />circus or carnival licensed by the city, any <br />veterinarian facilities, any bona fide research <br />institute using the described animals for <br />scientific research, or any bona fide educational <br />facility. <br /> <br />c. If, after making every reasonable attempt to seize <br />an animal subject to Subsection A of this section, <br />including the solicitation of assistance from the <br />animal's owner if the owner is immediately <br />ascertainable and available, the officer reasonably <br />determines the animal cannot be seized without <br />exposing the officer or other persons to personal <br />injury from the animal, the officer may destroy the <br />animal without notice to the owner. <br /> <br />D. The animal control officer and any police officer <br />has the authority to impound any animal subject to <br />Subsection A of this section. If the impounded <br />animal is a hybrid between a dog and a wolf or a <br />dog and a coyote, and the owner of the animal <br />disputes such hybrid classification, the following <br />procedure may be followed: <br /> <br />1. The owner may file a written petition with the <br />Director of the Department of Public Safety <br />for a hearing concerning such classification <br />no later than four (4) days after impoundment. <br />Such petition shall include the name and <br />address, including mailing address, of the <br />petitioner. <br /> <br />2. The Director will then issue a notice of <br />hearing date by mailing a copy to petitioner's <br />address no later than five (5) days prior to <br />the date of the hearing. <br /> <br />3. The hearing, if any, will be held before the <br />Director of the Department of Public Safety or <br />a hearing officer designated by the Director. <br />Any facts which the petitioner wishes to be <br /> <br />7 <br /> <br />1/-1 <br />
