To otherwise plan for and regulate the use of land so as to provide planned and orderly use of land and protection of the environment in a manner consistent with constitutional rights. Section 2. Louisville Municipal Code, Section 16.12.030, entitled "Preliminary plat -- Processing", Paragraph G. is amended and said Section 16.12.030 is further amended by the addition of the following new paragraph (words to be deleted are stricken through; words to be added appear in capital letters): 16.12.030 Preliminary plat -- Processing. G. within fifteen days after a preliminary plat is disapproved, or approved with modifications, the subdivider may request in writing a review before the planning commission OR MAY APPEAL SUCH DECISION TO THE CITY COUNCIL. H. WITHIN FIFTEEN DAYS AFTER A PRELIMINARY PLAT IS APPROVED OR APPROVED WITH MODIFICATIONS, THE CITY COUNCIL MAY CALL UP THE PRELIMINARY PLAT FOR ITS REVIEW. IN THE EVENT OF SUCH CALL UP OR IF A SUBDIVIDER APPEALS A DECISION OF THE PLANNING COMMISSION PURSUANT TO PARAGRAPH G OF THIS SECTION: 1. THE COUNCIL SHALL CONSIDER THE PRELIMINARY PLAT AT A PUBLIC HEARING HELD DURING A COUNCIL MEETING SUBSEQUENT TO THE DATE OF THE PLANNING COMMISSION'S ACTION ON THE PRELIMINARY PLAT, WITH NOTICE THEREOF PROVIDED IN THE SAME MANNER AS NOTICE OF THE PUBLIC HEARING BEFORE THE PLANNING COMMISSION; 2. PRIOR TO THE COUNCIL'S ACTION ON THE PRELIMINARY PLAT, IN ADDITION TO MATTERS PRESENTED AT THE PUBLIC HEARING, THE COUNCIL SHALL REVIEW AND CONSIDER THE PLANNING COMMISSION'S FINDINGS AND RECOMMENDATIONS, ANY STAFF REPORTS, AND THE MINUTES FROM THE PUBLIC HEARING BEFORE THE PLANNING COMMISSION; AND 3. THE COUNCIL MAY APPROVE, APPROVE WITH MODIFICATIONS, OR DENY THE PRELIMINARY PLAT AND SHALL MAKE EXPLICIT ITS FINDINGS IF DIFFERENT FROM THOSE OF THE PLANNING COMMISSION. 4
