<br />10 -Lf <br /> <br />R. To help assure that growth bears a reasonable share <br />of the costs thereof; and <br /> <br />S. To otherwise plan for and regulate the use of land <br />so as to provide planned and orderly use of land <br />and protection of the environment in a manner <br />consistent with constitutional rights. <br /> <br />Section 2. Louisville Municipal Code, Section 16.12.030, <br />entitled "Preliminary plat -- Processing", Paragraph G. is amended <br />and said Section 16.12.030 is further amended by the addition of <br />the following new paragraph (words to be deleted are stricken <br />through; words to be added appear in capital letters): <br /> <br />16.12.030 <br /> <br />Preliminary plat -- Processing. <br /> <br />G. within fifteen days after a preliminary plat is <br />disapproved, or approved with modifications, the <br />subdivider may request in writing a review before <br />the planning commission OR MAY APPEAL SUCH DECISION <br />TO THE CITY COUNCIL. <br /> <br />H. WITHIN FIFTEEN DAYS AFTER A PRELIMINARY PLAT IS <br />APPROVED OR APPROVED WITH MODIFICATIONS, THE CITY <br />COUNCIL MAY CALL UP THE PRELIMINARY PLAT FOR ITS <br />REVIEW. IN THE EVENT OF SUCH CALL UP OR IF A <br />SUBDIVIDER APPEALS A DECISION OF THE PLANNING <br />COMMISSION PURSUANT TO PARAGRAPH G OF THIS SECTION: <br /> <br />1. THE COUNCIL SHALL CONSIDER THE PRELIMINARY <br />PLAT AT A PUBLIC HEARING HELD DURING A COUNCIL <br />MEETING SUBSEQUENT TO THE DATE OF THE PLANNING <br />COMMISSION'S ACTION ON THE PRELIMINARY PLAT, <br />WITH NOTICE THEREOF PROVIDED IN THE SAME <br />MANNER AS NOTICE OF THE PUBLIC HEARING BEFORE <br />THE PLANNING COMMISSION; <br /> <br />2. PRIOR TO THE COUNCIL'S ACTION ON THE <br />PRELIMINARY PLAT, IN ADDITION TO MATTERS <br />PRESENTED AT THE PUBLIC HEARING, THE COUNCIL <br />SHALL REVIEW AND CONSIDER THE PLANNING <br />COMMISSION'S FINDINGS AND RECOMMENDATIONS, ANY <br />STAFF REPORTS, AND THE MINUTES FROM THE PUBLIC <br />HEARING BEFORE THE PLANNING COMMISSION; AND <br /> <br />3. THE COUNCIL MAY APPROVE, APPROVE WITH <br />MODIFICATIONS, OR DENY THE PRELIMINARY PLAT <br />AND SHALL MAKE EXPLICIT ITS FINDINGS IF <br />DIFFERENT FROM THOSE OF THE PLANNING <br />COMMISSION. <br /> <br />4 <br />
