<br />5~~ <br /> <br />WHEREAS, increases in certain water and sewer tap fees, and <br />dedication requirements will assist in defraying the costs of <br />providing or expanding City services made necessary by new <br />development within the City; and <br /> <br />WHEREAS, the increases in fees and dedication requirements <br />set forth herein are dedicated to the purpose of defraying the <br />costs of particular City services, and may not be used for general <br />City purposes; and <br /> <br />WHEREAS, the City Council of the City of Louisville hereby <br />determines that the increases in fees and dedication requirements <br />set forth herein are reasonably designed to defray the overall <br />costs of the services or facilities for which the fees are imposed, <br />and that the increases reasonably relate to the needs created or <br />contributed to by new development. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. section 13.12.020, entitled "Tap fee-- <br />Generally", Subsection C, is amended to read as follows (words to <br />be deleted are stricken through; words to be added appear in <br />capital letters): <br /> <br />C. The amount of the tap fee for residential units <br />shall be the amount determined by reference to <br />Tables A and B as set forth in Sections 13.12.030 <br />and 13.12.040, respectively; provided that the <br />minimum tap fee paid for each mUlti-family unit <br />OTHER THAN A TOWNHOUSE after payment in full for <br />the first tap issued shall be sixty percent of the <br />existing charge for a three-quarter inch tap AND <br />PROVIDED THAT THE MINIMUM TAP FEE PAID FOR EACH <br />TOWNHOUSE IN A GROUP OF ATTACHED TOWNHOUSES, AS <br />DEFINED IN LOUISVILLE MUNICIPAL CODE SECTION <br />17.08.560, AFTER PAYMENT IN FULL FOR THE FIRST TAP <br />ISSUED, SHALL BE EIGHTY (80%) PERCENT OF THE <br />EXISTING CHARGE FOR A THREE-QUARTER INCH TAP. <br /> <br />section 2. Section 13.12.040, entitled "Tap fee -- Table <br />B.", only the following portion of Subsection A is amended, and a <br />new Subsection D is added, to read as follows (numbers and words to <br />be deleted are stricken through; numbers to be added are <br />underlined; and words to be added appear in capital letters): <br /> <br />13.12.040 Tap fee -- Table B. <br /> <br />A. The tap fee shall be computed by reference to <br />section 13.12.030, aaa the appropriate Table B, AND <br />SUBSECTION D of this section. <br /> <br />2 <br />
