Section 9.46.040 of the Louisville Municipal <br />Code is amended to read as follows (words to be deleted are <br />stricken through; words to be added appear in capital letters): <br /> <br />9.46.040 Shoplifting. <br /> <br />If any person knowingly conceals unpurchased goods, <br />wares, or merchandise of a value of less than ~ FOUR <br />hundred dollars owned or held by and offered or displayed <br />for sale by any store or other mercantile establishment, <br />whether such concealment be on his person or otherwise <br />and whether on or off the premises of such store or <br />mercantile establishment, such concealment shall <br />consti tute prima facie evidence that such person intended <br />to convert the same to his own use without paying the <br />purchase price therefor within the meaning of Section <br />9.46.030. <br /> <br />Section 3. Section 9.92.020 of the Louisville Municipal <br />Code is amended to read as follows (words to be deleted are <br />stricken through; words to be added appear in capital letters; <br />numbers to be added are underlined): <br /> <br />9.92.020 Issue of Check with Intent to Defraud. <br /> <br />It shall be unlawful to commit fraud by check. Any <br />person, knowing he or she has insufficient funds with the <br />drawee, who, with intent to defraud, issues a check for <br />the payment of services, wages, salary, commissions, <br />labor, rent, money, property, or other things of value <br />commits fraud by check. This section shall only apply <br />where the fraudulent check was for the sum of less than <br />$300.00, FOUR HUNDRED DOLLARS and where the offender has <br />not been twice previously convicted under S18 5 205, !H8- <br />5-205(3) (c), C.R.S., as amended, or a former statute of <br />the State of Colorado of similar content and purport. <br /> <br />Section 4. The City Council herewith finds, determines, <br />and declares that this ordinance is necessary for the immediate <br />preservation of the public health and safety in order to conform <br />City ordinances to state statutes in a timely manner, and this <br />ordinance shall take effect upon adoption and signing by the Mayor <br />if approved by three-fourths of the members of the City Council. <br /> <br />Section 5. If any portion of this ordinance is held to be <br />unconstitutional or invalid for any reason, such decision shall not <br />affect the validity or constitutionality of the remaining portions <br />of this ordinance. The City Council hereby declares that it would <br />have passed this ordinance and each part hereof irrespective of the <br />fact that anyone part be declared unconstitutional or invalid. <br /> <br />2 <br />
