<br />~lo -1 <br /> <br />Section 10. Ratification and Approval of Prior Actions. <br />All actions heretofore taken by the officers of the City and <br />members of the Council, not inconsistent with the provisions of <br />this Ordinance, relating to the Financing Documents, or actions to <br />be taken in respect thereof, are hereby ratified, approved, and <br />confirmed. <br /> <br />Section 11. Authority's Official Statement. The <br />appropriate officers and employees of the City are hereby <br />authorized and directed to furnish and supply information <br />concerning the City to the Authority for use in the preparation of <br />an Official statement to be used to market the Authority's Bonds. <br /> <br />Section 12. Repealer. All acts, orders, ordinances, or <br />resolutions, or parts thereof, in conflict herewith are hereby <br />repealed to the extent of such conflict. <br /> <br />Section 13. Severability. Should anyone or more <br />sections or provisions of this Ordinance be judicially determined <br />invalid or unenforceable, such determination shall not affect, <br />impair, or invalidate the remaining provisions hereof, the <br />intention being that the various provisions hereof are severable. <br /> <br />Section 14. Ordinance Irrepealable. After the Bond is <br />issued, this Ordinance shall be and remain irrepealable until the <br />Bond and the interest thereon shall have been fully paid, <br />satisfied, and discharged. <br /> <br />Section 15. Emergency Declaration. It is hereby found <br />and determined that: (i) the Project is immediately necessary in <br />order to provide a safe and adequate source of water to the City <br />and its residents and customers; (ii) certain of the costs of the <br />Project have heretofore become due and payable, and the City has <br />advanced funds to pay such costs in anticipation of reimbursement; <br />(iii) such costs will continue to become due and payable in the <br />immediate future; and (iv) the schedule for the purchase of the <br />Bond requires that this Ordinance be made effective on or prior to <br />April 16, 1992. As a result, it is hereby found and determined <br />that this Ordinance is necessary to the immediate preservation of <br />the public health and safety, and shall take effect upon adoption <br />in accordance with ~31-16-105, C.R.S. <br /> <br />Section 16. Publication. This Ordinance, after its <br />final passage, shall be published as required by law, recorded in <br /> <br />- 6 - <br />
