~lo -1 Section 10. Ratification and Approval of Prior Actions. All actions heretofore taken by the officers of the City and members of the Council, not inconsistent with the provisions of this Ordinance, relating to the Financing Documents, or actions to be taken in respect thereof, are hereby ratified, approved, and confirmed. Section 11. Authority's Official Statement. The appropriate officers and employees of the City are hereby authorized and directed to furnish and supply information concerning the City to the Authority for use in the preparation of an Official statement to be used to market the Authority's Bonds. Section 12. Repealer. All acts, orders, ordinances, or resolutions, or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict. Section 13. Severability. Should anyone or more sections or provisions of this Ordinance be judicially determined invalid or unenforceable, such determination shall not affect, impair, or invalidate the remaining provisions hereof, the intention being that the various provisions hereof are severable. Section 14. Ordinance Irrepealable. After the Bond is issued, this Ordinance shall be and remain irrepealable until the Bond and the interest thereon shall have been fully paid, satisfied, and discharged. Section 15. Emergency Declaration. It is hereby found and determined that: (i) the Project is immediately necessary in order to provide a safe and adequate source of water to the City and its residents and customers; (ii) certain of the costs of the Project have heretofore become due and payable, and the City has advanced funds to pay such costs in anticipation of reimbursement; (iii) such costs will continue to become due and payable in the immediate future; and (iv) the schedule for the purchase of the Bond requires that this Ordinance be made effective on or prior to April 16, 1992. As a result, it is hereby found and determined that this Ordinance is necessary to the immediate preservation of the public health and safety, and shall take effect upon adoption in accordance with ~31-16-105, C.R.S. Section 16. Publication. This Ordinance, after its final passage, shall be published as required by law, recorded in - 6 -
