applying for a retail marijuana license. An existing medical marijuana business may apply for a
<br /> retail marijuana license in accordance with all State and local laws and regulations. Any retail
<br /> marijuana license issued to an existing medical marijuana business shall: (1)be limited to use at the
<br /> premises specified in the medical marijuana business license issued by the Louisville Local
<br /> Licensing Authority as of the effective date of Ordinance No. 1643, Series 2013, or premises within
<br /> 1,320 feet of the aforementioned premises subject to compliance with all applicable regulations
<br /> except for the separation requirements between medical marijuana businesses set forth in Sections
<br /> 5.10.070.A and Section 17.16.235.B.1 of the Louisville Municipal Code with which the existing
<br /> medical marijuana business does not comply as of the effective date of Ordinance No. 1643, Series
<br /> 2013; and (2) shall be subject to non-renewal in the event retail marijuana establishments are
<br /> prohibited within the City through the enactment of an ordinance or by vote of the registered
<br /> electors of the City,which prohibition shall constitute"good cause" for non-renewal of a license
<br /> Section 2. For purposes of this ordinance, "existing medical marijuana business" shall
<br /> mean any medical marijuana business that,prior to the effective date of Ordinance No. 1643, Series
<br /> 2013, has been issued a medical marijuana business license from the Louisville Local Licensing
<br /> Authority and the State Licensing Authority and has been continuously operated as a medical
<br /> marijuana business in accordance with state and local laws and regulations since such date. "Retail
<br /> marijuana," "retail marijuana establishment," "medical marijuana," and "medical marijuana
<br /> business" shall have the meanings ascribed to them in Article XVIII, §14(1) and §16(2) of the
<br /> Colorado Constitution, C.R.S. §12.43.3-103 and §12-43.4-103, any rules adopted by the
<br /> Colorado Department of Revenue, and Chapter 5.10 of the Louisville Municipal Code and such
<br /> definitions are hereby incorporated into this ordinance by reference.
<br /> Section 3. Except as provided in Sections 1 and 2 of this Ordinance and without
<br /> limiting the other provisions of Ordinance No. 1643, Series 2013, upon the effective date of this
<br /> ordinance and until December 31, 2014, it is unlawful for any person to engage in any other form
<br /> of business, commerce, enterprise or establishment involving the cultivation, processing,
<br /> preparing, manufacturing, storage, sale, testing, distribution, use or consumption of marijuana.
<br /> Further, during such time, no application or request for business registration, sales tax license,
<br /> building permit, or certificate of occupancy for any such business, commerce, enterprise or
<br /> establishment shall be received,reviewed, approved, or otherwise acted upon.
<br /> Section 4. Nothing in this Ordinance shall be construed to prohibit, regulate or
<br /> otherwise impair the protections for the personal use of marijuana as provided in Article XVIII,
<br /> Sections 15 and 16 of the Colorado Constitution.
<br /> Section 5. If any portion of this ordinance is held to be invalid for any reason, such
<br /> decision shall not affect the validity of the remaining portions of this ordinance. The City Council
<br /> hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact
<br /> that any one part be declared invalid.
<br /> Section 6. The repeal or modification of any provision of the Municipal Code of the
<br /> City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole
<br /> or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred
